The objective of will writing is to express your wishes on how your estate must be distributed after your death and also other wishes such as who must take care of your children or the family business. With a will, financial hardship to the deceased’s dependants (i.e children and wife) can be minimised or avoided. However, The Will Act is only applicable for non-muslims.

📌QUESTION: I am getting married earlier next year. However, I am worried about the outcome if my marriage does not work out. As I have heard of couples signing premarital agreements, may I know if premarital agreement is enforceable in Malaysia?
Premarital agreement is also known as prenuptial agreement in which it is a contract by choice that will be signed by both, bride and groom prior to marriage.
To answer the question stated above: YES, it is enforceable in Malaysia.
Divorce can be incredibly messy and damaging for both parties. Don't worry, the prenuptials signed MUST protect both spouses to be hold up in court. Hence, this means that BOTH spouses' rights will be protected.
❗️Opting for the agreement DOES NOT MEAN that a couple is anticipating divorce. It's to save both parties from any possiblities that might happen in the future.
