“Mummy, why can’t Daddy just come home?”

I’m 9 years old.

My house has two names on it — Mummy’s and Daddy’s.
The bank loan also has two names.

But after the divorce, nobody talked about the house.
The court order said who I live with (Mummy).
It didn’t say what happens to the home.

A few months later, Daddy came back.
We tried to be a family again.

Then one day… he disappeared.

No calls.
No messages.
No money for the house.
Just silence.

For one whole year, Mummy paid the bank alone so our home wouldn’t be auctioned. I saw her sitting at the dining table every night with papers and a calculator. I saw her cry quietly when she thought I was asleep.

She couldn’t tahan anymore. She made a police report.

That’s when we found out — Daddy was still in Malaysia.
He had changed his number.
He had a new girlfriend.

With police assistance, he admitted everything.
He told Mummy to “move on without him.”

That day, she cried while telling her lawyer the whole story.

💔 Why She Did Not Take Action Earlier

For a long time, she did not initiate legal proceedings over the house.

Not because she was careless.
Not because she did not know her rights.

But because she still hoped they could rebuild their family.

She believed the disappearance was temporary.
She believed he would return.
She believed love would fix what law could not.

While we felt deeply sorry for her situation,
we also had to explain something difficult:

Hope does not pause loan obligations.
Emotion does not suspend liability.

⚖️ Hard Truth About Divorce & Property

Under Malaysia's Law:

1️⃣ If a divorce order does not mention the matrimonial home, ownership does not automatically change.
If the house is under joint names, both parties remain legal owners.

2️⃣ If the housing loan is under joint borrowers, both remain legally liable to the bank.
Even if one spouse disappears.
Even if one spouse stops paying.
Even if there is a new partner.

The bank does not care about divorce.
The bank cares about repayment.

If instalments are not paid, auction proceedings can still commence.

Here is what many people do not realise:

If property division is not properly negotiated, recorded, and sealed in a court order at the time of divorce, it becomes a future dispute — often more expensive, more painful, and far more complicated.

And the child silently absorbs everything.

📌 Public Reminder

If you are going through divorce:

✔ Ensure your consent order clearly addresses property division
✔ Decide who will take over the loan — and execute proper transfer
✔ If refinancing is needed, do it early
✔ Never leave joint assets “to settle later”

“Later” often becomes a legal and financial nightmare.

Choose Your Divorce Lawyer Wisely

Divorce is not just about ending a marriage.

It is about:
• Securing your financial footing
• Structuring your property rights
• Protecting your child’s stability
• Avoiding years of future litigation

💔 为什么她没有早点采取行动？

很长一段时间，她没有针对房子采取法律行动。

不是因为她不懂法律。

⚖️ 关于离婚与财产的残酷现实

根据马来西亚法律：

1️⃣ 如果离婚判决书没有处理夫妻共同房产，产权不会自动改变。
只要是联名产权，双方仍然是合法屋主。

2️⃣ 如果房屋贷款是联名借款人，双方仍然对银行负全部责任。
即使一方消失。
即使一方停止付款。
即使对方有了新伴侣。

银行不关心你是否离婚。
银行只关心贷款是否按时偿还。

一旦断供，银行仍然可以启动拍卖程序。

很多人不知道的是：

如果在离婚时没有妥善处理夫妻财产分配，
未来往往演变成更昂贵、更痛苦、更复杂的法律纠纷。

而孩子，被迫默默承受一切。

📌 给正在办理离婚的人一个提醒

✔ 确保离婚同意判令清楚处理财产分配
✔ 明确谁承担房贷责任，并办理产权转移
✔ 如需重新融资，应尽早安排
✔ 不要把联名资产“留到以后再说”

“以后再说”，
往往变成“以后对簿公堂”。

选择离婚律师，要慎重。

离婚，不只是结束一段婚姻。

💔 A suspected affair, family battles, and a house at risk — a marriage finally resolved through patience and strategy

Married in 2018, with no children, the couple’s marriage eventually broke down.

They moved back to their respective families and stopped communicating directly, relying on family members and friends, who soon began fighting on their behalf.

The conflict escalated:
– Both refused to pay house instalments; the jointly owned house faced imminent auction (lelong)
– Disputes over gold jewellery and marriage gifts
– Allegations of spy cameras, secret audio recordings, and GPS tracking

⚖️ Our intervention (September 2025):
We met directly with the couple and began multiple mediation sessions.

At first, the sessions were challenging — neither spouse was willing to compromise, and conflicts often flared.

🏥 "I never thought I’d be signing my Will in a hospital bed… until today."

Earlier last week, our client, a gentleman in his early 50s, was unexpectedly admitted to the hospital. His condition was critical, and he realized: he had not yet made a Will.

From the moment he contacted us, we arranged for our lawyer, Ms Wayne, to prepare, finalize, and oversee the signing of his Will. The entire process was completed within 2 hours—even at night. Ms Wayne arrived at the hospital with all necessary documents and worked quickly but carefully.

In the quiet of the hospital room, with the hum of medical machines around, she guided him through every legal requirement:

Capacity – ensuring he fully understood each decision.
Voluntariness – the Will had to be signed freely, without any pressure.
Witnesses – two non-beneficiaries were present.

✍️ By that night, his Will was signed—accurately reflecting his intended arrangements and beneficiaries. Even in a hospital bed, our client gained peace of mind, knowing his wishes were legally secured.

💡 Legal Tip:
👉A valid Will requires two witnesses who are not beneficiaries to prevent conflicts of interest.
👉Witnesses do not need to know the content of the Will—they are there to observe the signing and confirm the testator’s capacity and to ensure the Will is signed voluntarily.
