✅ RAYUAN-RAYUAN DARI JABATAN TENAGA KERJA (“JTK”) KE MAHKAMAH TINGGI BERJAYA
1. Anakguam telah diawadkan kontrak pembersihan sekolah-sekolah.
2. Beberapa bekas pekerja kontrak Anakguam telah memfailkan 5 Kes tuntutan terhadapnya pada akhir 2024 di Jabatan Tenaga Kerja kononnya bagi tuntutan gaji minimum tertunggak disebab adanya Perintah Gaji Minimum 2022. Pengarah JTK yang mendengar kes-kes membenarkan tuntutan mereka.
3. Syukur, Mahkamah Tinggi benarkan rayuan-rayuan kami dan perintah JTK tersebut adalah diketepikan:
- tuntutan-tuntutan adalah diluar masa (“out of time”) menurut s.33(1)(c) Akta Kerja 1955;
-Tidak ada isu pengkayaan tidak adil, kerana Anakguam kami bayar gaji mengikut “pay & claim” kepada pihak Kerajaan iaitu mengikut skala gaji minimum lama & tender kontrak asal. Selepas penyelarasan baru, Anakguam kami telah pun bayar gaji ikut harga baru yang diselaras & Perintah Gaji Minimum 2022.

SUCCESFULLY REPRESENTED EMPLOYER IN APPEALS FROM THE LABOUR COURT TO THE HIGH COURT
1. Client was awarded cleaning contracts for school buildings.
2. Several former contract workers filed 5 cases against Client in late 2024 at the Department of Labour/Labour Court for outstanding minimum wage claims from 2022 due to the new “Minimum Wage Order”. Initially, the parties discussed and the workers agreed that the balances need not be paid. However, the Director of Labour presiding allowed their claims.
3. The Hight Court allowed our appeals:
- S.33(1)(c) of the Employment Act 1955 - the time limit for claiming outstanding wages is only 90 days (3 months) from the date it was supposedly due;
-There is no unjust enrichment because our Clients paid salaries according to a “pay & claim" system, pursuant to the original award. After the Government issued a new variation of the awarded sum, our Client paid salaries according to the new award & Minimum Wage Order 2022.
