CRIME WATCH | KNOW YOUR LAW SERIES | VKA TIMES | CAN MONEY LAUNDERING OFFENCES BE COMPOUNDABLE?

In this week’s edition of VKA Times, we take a look at compound in money laundering offences. As many would have already known, the criminal offences in Malaysia can be divided into compoundable and non-compoundable offences.

Under Section 92 of the Anti-Money Laundering, Anti-Terrorism Financing Proceeds of Unlawful Activities Act 2001 ("AMLATFA"), compounds are allowed for any offence under the Act upon the consent of the Public Prosecutor ie Attorney General.

The rationale behind the section is, the AMLATFA deals with proceeds of unlawful activity. Therefore, the government may elect to recover the said proceeds of unlawful activity in form of compound.

The Attorney General by his powers vested under Article 145 of the Federal Constitution and Section 376 of the Criminal Procedure Code has the powers to initiate, discontinue and to control all criminal prosecutions and proceedings. Hence, the AG may make a policy decision if a person charged under the AMLATFA can pay a compound in place of a punishment.

On 05.05.2020, the newly appointed MACC Chief Commissioner, Datuk Seri Azam Baki, issued a statement stating that the anti-graft enforcement body is scrutinising a proposal to suspend the implementation of the said section.

MACC chief commissioner Datuk Seri Azam Baki said this was due to demands, especially from companies that were not prepared for the appropriate anti-corruption plan, further proving our concern on its feasibility raised in our article.

Come 01.06.2020, Malaysia will witness the criminalisation of gratification or what is known in common parlance as corruption committed by a commercial organisation via the introduction of Section 17A of the Malaysian Anti-Corruption Act 2009 (MACC Act 2009).

From a Malaysian context, this is a rather unique development since all these while, the emphasis of Malaysia Anti-Corruption laws has been on offences committed by the individual person.
