Administration of Estate/遗产管理

If the deceased died leaving behind a Will, the Executor of the Will need to apply to the High Court for a Probate to allow the Executor to distribute the deceased's estate in accordance to the Will. If the deceased died without a Will, the beneficiaries will have to apply to the High Court for a Letter of Administration to appoint an Administrator to distribute the deceased's estate in accordance to the law. If it is a small estate with immovable property, the beneficiaries may apply to the Land Office for distribution of estate under the Small Distribution Estate Act 1955.

在往生者有立遗嘱的情况下,往生者在其遗嘱里命名的执行人必须向法庭申请遗嘱认证书,然后根据遗嘱的内容来分配往生者的遗产。

如果是在没有遗嘱的情况下去世,那么往生者的合法继承人必须向高等法庭申请遗产管理书,再依法分配往生者的遗产。

如果往生者的遗产是属于小额遗产,遗产包括至少一个不动产,往生者去世的时候也没有立下遗嘱, 那么死者的受益人是可以根据马来西亚小额遗产分配法向土地局申请遗产转名.

3 Things You Need To Know About Divorce

1. Married couples can mutually agree to divorce provided the couples must have been married for at least two (2) years at the time the petition for divorce is filed.
2. If there is no mutual agreement, either party to a marriage may only file a petition to divorce on the ground that the marriage has broken down.
3. The break down of the marriage can be grounded one of the reasons as follows:
a) that the other party has committed adultery;
b) that the other party has behaved in such a way that it cannot reasonably be expected to live together;
c) that the other party has deserted for a continuous period of at least 2 years; OR
d) that the parties to the marriage have lived apart for a continuous period of at least 2 years.
