Justice Served!
Today, the Court of Appeal Judges unanimously allowed our appeal. Our client had faced the death penalty after being convicted under section 302 of the penal code by the High Court Judge of Shah Alam.

The decision was overturned, and our client was freed after spending six years in prison (from September 2018). Had the conviction been upheld, our client could have faced the gallows (death penalty) or a life sentence under Section 34 of the Abolition of Mandatory Death Penalty Act 2023 (Act 846).

We express our gratitude to the almighty and our dedicated team at T Harpal, who worked tirelessly to ensure justice was served. This case reaffirms our commitment to upholding justice and maintaining the rule of law. It underscores the importance of fair legal proceedings.

Today, I am delighted to share the news that my client has been granted bail. The charges brought against them were under Section 26A of the Anti-Trafficking In Persons and Smuggling of Migrant 2007 Act, commonly known as Atipsom.

This favorable outcome was achieved through the wisdom and judgment of Kuala Lumpur High Court Judge YA Tuan Muniady, who concurred with the decision rendered by the Federal Court Judges in the case of Koh Chin Wah.

It is noteworthy that bail was granted under the provisions of Section 388 of the Criminal Procedure Code (CPC), highlighting the alignment of our case with established legal principles.

My client was not alone in this legal matter, as they faced charges alongside four other co-accused individuals. They were effectively represented by legal professionals of high repute, including my esteemed learned brother, Mr. Varghese and Mr.Gabriel, alongside another accomplished legal expert.

I would like to take this opportunity to extend my heartfelt gratitude to the dedicated team at T.Harpal & Associates, whose unwavering support and diligent efforts have played an indispensable role in securing this favorable outcome. Additionally, I wish to express my thanks to the Divine for guiding us throughout this challenging journey.

The High Court Judge, YA Azhar Abdul Hamid granted my client's RM15,000 bail with one surety, ordered that her passport to be impound in court, and mandated that she appears twice a month at the neighbourhood police station.

My client & her husband was arrested and charged in court under section 26A of Anti Trafficking in Person and Smuggling of Migrant Act 2007.

During the Trial, we look forward to disputing this charge in court.

The two-parent pair (Husband & Wife) was both detained in April 2023, and charges were filed against them in a session court the following month.

Immigration and the prosecution both adopted Sosma as their procedural law for their investigations and prosecutions.

After spending two months in remand custody, my client is at last reunited with her family.

On 10.05.2023, the learned Session Court Judge of Mahkamah Sesyen Khas PATI Semenyih, Puan Hakim Noorasyikin Binti Sahat acquitted and released our clients who were charged with few counts of section 55E (for employing a person without a valid pass) and section 55B (for allowing an illegal immigrant to enter premise) of the Immigration Act 1959/63 [Act 155].

Our First Client was charged with two counts of section 55B Act 155 for employing 46 migrants and 5 migrants without valid pass respectively. In addition to that, he was also charged with section 55E Act 155 for allowing 9 illegal migrants to enter or remained in the premise.

As for our Second Client, he was charged with two counts of section 55B Act 155 for employing 5 illegal migrants and 6 illegal migrants respectively in the said premise.

For all the offences charged under Section 55B Act 155, the learned judge held that the prosecution had failed to prove two essential elements of the charge, namely that our clients were the employers and the migrants did not have valid passes to work there.

Whereas for the offence of Section 55E Act 155, the learned judge held that the prosecution had failed to prove that our clients had given permission to allow the illegal immigrants to enter or remain in the premise.

As such, it was held that the prosecution had failed to prove a prima facie case against our clients and they were ordered to be released. Thanking to Almighty and my team at T.Harpal & Associates
