Our legal team successfully secured the Court of Appeal's unanimous decision to quash the unilateral conversion of three children to Islam. The court ruled the conversion, done without the mother's consent, null and void.

"The failure to answer these two issues is a clear misdirection that is tantamount to an error in law. On the issue of unilateral conversion, we are bound with the decision in the Indira Gandhi case which held that the consent of both parents must be obtained before minor children can be converted to another religion."
"Therefore, we allow the appeal by the applicant (Loh) and set aside the High Court's decision," Justice Hadhariah said here on Wednesday (Jan 10).
Other judges on the bench were Justices Hashim Hamzah and Azhahari Kamal Ramli.

This landmark judgment upholds the principle that both parents must consent to the conversion of minor children. The children, now 16 and 13, are rightfully recognized as Hindus.

Application DISMISSED!

MAIPS filed an application to vary Ms Loh’s custody order, where MAIPS seek for access to the children in providing Islamic teachings and bringing the youngest son to mosque every Friday.
Back in 2020, the father had abducted the children and converted them from Hindu to Muslim unilaterally, i.e., without the mother's consent. At that time and till date, Siew Hong was granted the sole care, custody, control and guardianship of her children.

The Federal Court case of Indira Gandhi Mutho v Pengarah Jabatan Agama Islam Perak & Ors [2018] 3 CLJ 145 held that unilateral conversion of the children's religion is illegal. On a purposive interpretation of Article 12(4) read with the Eleventh Schedule of the Federal Constitution, and the application of Sections 5 and 11 of the Guardianship of Infants Act 1961, it was decided that the consent of both parents are required before the certificates of conversion can be issued.

Nevertheless, the issue before this honourable court is not whether the conversion is illegal - even though the court has to take this into account - but whether MAIPS has good grounds to vary the order.

The High Court Judge, YA Puan Hayatul Akmal held that the access applied for is intrusive and disrespecting the mother, who has the sole guardianship, and sole care, custody and control of all 3 of her children.

The Judge also interviewed the children - they are capable of expressing the views, and they expressly said they DO NOT WANT TO BE MUSLIMS.

Even though the children’s wishes are irrelevant under the Federal Constitution, it has to be taken into account. They should not be forced to do what they don’t like. The welfare of the children is of paramount importance.

The court also agreed with our arguments that unilateral conversion of religion of the children is wrong in law, and Indira Gandhi still stands.

Enough is enough.

It’s a victory!

Executed a court order to get the child back after the mother, our client, was refused any access and custody of the child.

The father refused, and with the help of PDRM in Penang, we successfully returned the child back to our client.
