Counterfeit products may be removed from an online marketplace, but they can reappear through a different seller account.

As e-commerce continues to grow, brand owners face increasingly complex challenges in monitoring listings and protecting their trademarks. This also raises an important question: what responsibilities should online platforms bear?

In our latest article, our Head of Trademark, Lim Eng Leong, examines Malaysia’s developing approach to e-commerce platform accountability and practical measures that brand owners can consider when addressing online counterfeits.

Team Building in Historic Melaka

The People of Henry Goh came together for a two-day team-building programme in Melaka on 15–16 August 2026.

Divided into six cross-departmental teams, our colleagues took on a series of activities that encouraged strategic planning, effective communication, creative thinking and problem-solving.

A highlight of the programme was the Heritage Hunt, which took the teams on an approximately four-kilometre journey through historic Melaka—from Dutch Square and St Paul’s Church to the lively streets around Jonker Walk. Despite the hot weather, everyone worked enthusiastically to solve puzzles, find clues and complete the challenges together.

Congratulations to D**k Donk, the team that emerged in first place, and well done to all six teams for their wonderful participation and team spirit.

It was a memorable weekend filled with energy, laughter and stronger connections across Team HG.

Did you know that essential oils may fall under four different trademark classes?

Under the 13th edition of the Nice Classification, the appropriate class depends on how the essential oils are intended to be used:

• Industrial use — Class 1
• Cosmetic use — Class 3
• Medical use — Class 5
• Food use — Class 30

For businesses developing or expanding an essential-oil product range, the product name alone may not determine the correct trademark class. The product’s intended purpose should also be considered when preparing a Malaysian trademark application.

Scroll through our quick guide and save it for future filing preparations. Share it with other business owners or colleagues who may find it useful.

Malaysia’s patent landscape has entered a new phase.

Under the post-grant patent opposition system, any interested person may oppose a granted Malaysian patent before MyIPO.

One important distinction concerns the deadline: the six-month opposition period begins from the publication of the grant in the Intellectual Property Official Journal (IPOJ)—not from the patent grant date. No extension of time is permitted.

This distinction is important for patent owners, businesses and other interested parties monitoring granted patents in Malaysia.

Scroll through the carousel for the key points.

There’s a difference between using a brand…
and actually owning it.

Many businesses focus on visibility, marketing, and growth.

But ownership is what gives your business control and protection.

And that difference usually only becomes obvious when someone challenges your rights.

Growth without protection is just delayed risk.

At the beginning, the problem may not seem obvious.

But as your business grows, so does your exposure.

The more recognition your brand gains, the more important protection becomes.

Because growth attracts attention.

And not all attention is good.

A granted patent can still face further review.

That’s what post-grant opposition introduces into Malaysia’s patent system.

For businesses, this means patent protection is no longer just about getting approval.

It’s also about how strong the patent is when challenged later.

The real strength of a patent is often tested after it is granted.
