Suing someone in court is usually not the first option to resolve disputes. It is also not the only option available. However, sometimes it is a necessary last resort after all other measures have been exhausted but to no avail.

不明白为何首相会辞职？下一任首相会怎样被委任？让我们从联邦宪法的角度来为你分享。

1. 为什么首相辞职或需要辞职？

因为首相失去了多数下议院国会议员的支持。

多数的意思是超过半数的下议院国会议员。目前我们有220位下议院国会议员，因为有两位国会议员之前已离世。因此，要掌握多数下议院国会议员的信任意味着首相必须得到至少111位下议院国会议员的支持。

联邦宪法43(4) 条文阐明一旦首相不再掌握多数下议院国会议员的信任，首相和全体内阁必须（强制性的）辞职，除非最高元首在首相的请求下同意解散国会。

2. 为什么全体内阁部长需要辞职？

根据联邦宪法43(2) 条文，内阁的委任有两个层面。首先，最高元首必须在下议院国会议员当中委任一位可能会掌控多数下议院国会议员支持的人选成为首相。首相被委任过后，最高元首才会在首相的建议下委任内阁部长。由于首相的委任先于内阁部长的委任，因此一旦首相辞职，全体内阁也无法继续下去。

再者，新内阁的部长委任是属于下一任首相的酌处权。

3. 最高元首要如何委任下一任首相？

联邦宪法43(2)(a) 条文阐明最高元首必须在下议院国会议员当中委任一位可能会掌控多数下议院国会议员支持的人选成为首相。国会下议院议长已于17/8/2021致函要求下议院国会议员向国家元首呈上他们各自的法定宣誓书以表明他们支持成为大马第九任首相的人选。国家元首将根据国会议员们的法定宣誓书判断出一位可能会掌控多数下议院国会议员支持的人选成为下一任首相。

Wonder why the former Prime Minister resigned? How a new Prime Minister is going to be appointed? Let us share with you from the angle of the Federal Constitution.

1. Why the Prime Minister resigned or has to resign?

The Prime Minister has lost the support of the majority of Members of the Dewan Rakyat (MPs).

Majority means more than half of the total number of MPs. Currently, we have 220 MPs in the Dewan Rakyat as two MPs had passed away earlier. Hence to command the confidence of the majority means the Prime Minister has to get the support of at least 111 MPs.

Article 43(4) of the Federal Constitution is clear that once the Prime Minister ceases to command the confidence of the majority of MPs, he and his cabinet shall (mandatory) resign, unless the Yang di-Pertuan Agong (YDPA) dissolves the Parliament at the Prime Minister’s request.

2. Why the whole Cabinet has to resign?

Under Article 43(2) of the Federal Constitution, the appointment of the Cabinet is two-tier. First, the YDPA shall appoint as Prime Minister an MP who is likely to command the confidence of the majority of MPs. It is only upon the appointment of the Prime Minister, then only the appointment of the ministers by the YDPA on the advice of the Prime Minister. As the appointment of Prime Minister precedes the appointment of ministers, it follows that once the Prime Minister has resigned, the whole Cabinet can no longer stand.

The appointment of ministers in the new cabinet shall be the discretion of the next Prime Minister.

3. How should the YDPA appoint the next PM?

Article 43(2)(a) of the Federal Constitution provides that the YDPA shall appoint an MP (Ahli Dewan Rakyat) who is likely to command the confidence of the majority of MPs. On 17/8/2021, the Speaker of the Dewan Rakyat has requested all MPs of the Dewan Rakyat to submit their statutory declaration to the Palace to indicate which MP that they support to become the 9th Prime Minister of Malaysia. Based on the respective statutory declarations of the MPs, the YDPA shall then exercise his judgment to determine the MP who is likely to command the confidence of the majority of MPs to be appointed as the next Prime Minister.
