Lim Wei Jiet will be a speaker in a Malaysian Medical Association (MMA) webinar titled "Incident Reports & Internal Inquiries - Confidential? Or Not?". This is the 4th instalment of its Medico-Legal Case Studies series.

When an unfortunate incident occurs in hospitals, incident reports & internal inquiries are generally required to be done. The aim is to prevent subsequent harm by learning from previous mistakes. Therein lies the requirement for confidentiality, so that a safe & non-punitive atmosphere in which healthcare personnel can participate without fear of liability or harm to reputation is assured.

There is however an increasing trend for pre-action discovery of incident reports & internal inquiries, on the basis of transparency.

How does & should the Court balance these competing interests?

Hospital administrators, doctors & healthcare personnel are encouraged to attend. You can register at https://lnkd.in/evRkzy-j

Our Lim Wei Jiet will act as lead counsel for the founders of Parti Kemakmoran Negara, a political party comprising armed forces veterans, who have filed a judicial review today (7th July 2022) at the KL High Court.

The suit was filed because of the delay of the Minister of Home Affairs in reaching a decision on the party’s appeal against the Registrar of Societies’ decision on 16.3.2022 to reject its registration. 113 days (close to 4 months) have passed since the appeal and no decision has been made yet by the Minister.

In the suit, the founders are claiming that such delay is unreasonable, unlawful & an infringement on the right to form associations under the Constitution.

The founders of the party are seeking a Court order for the Minister to make a decision on the appeal within 7 days, should the judicial review succeed.

The party is lead by Brig Gen (Rtd) Dato’ Abdullah bin Mohamed, who served with distinction primarily in the Royal Malaysian Air Force. He was involved in various counter-insurgency measures against the communists in the 70s and 80s. He holds an MA in Strategic Studies at Lancaster University, UK and an MBA from Oklahoma City University, USA. He is an active leader of the Retired Armed Officers Association (RAFOC), Persatuan Veteran ATM (PVATM) and Persatuan Veteran TUDM (PVTUDM).

The other founders of the party are comprised of veterans from the Malaysian Armed Forces, Royal Malaysian Navy & Royal Malaysian Air Force.

A group of armed forces veterans who are founders of Parti Kemakmoran Negara has filed a judicial review at the High Court here on Thursday (July 7) to compel the Home Affairs Minister to make a decision on the group's appeal against the rejection of the party's registration.
