Alhamdulillah.

Memberi perkongsian di Astro Awani pagi ini, tentang kemelut Israel-Palestin terkait pendengaran awam dalam prosiding Pendapat Nasihat yang sedang berlangsung di ICJ, yang juga turut disertai oleh Malaysia.

Esok, Datuk Seri Utama Hj Mohammad bin Hassan, Menteri Luar akan membuat hujahan lisan di ICJ. Sama-sama kita doakan agar hujahan Malaysia diterimapakai. Rakan-rakan saya di Yayasan MyAqsa juga telah berada di The Hague untuk sama-sama menyertai prosiding.

Penyebaran Berita Palsu

Semalam di Zayan FM saya berkongsi secara ringkas tentang kesalahan menyebarkan berita/maklumat palsu.

Ada 3 kategori yang saya tekankan:-

1️⃣ Kesalahan menyalahgunakan media sosial untuk menyebarkan berita/maklumat palsu;

2️⃣ Kesalahan menyebarkan maklumat palsu sehingga menyebabkan ketakutan dan kegentaran awam;

3️⃣ Kesalahan menyebarkan maklumat palsu berkaitan dengan wabak Covid 19

Kesalahan pertama boleh didakwa di bawah Seksyen 211 atau 233 Akta Komunikasi dan Multimedia 1998 yang membawa hukuman denda sehingga RM50,000 atau penjara sehingga 1 tahun.

Kesalahan kedua boleh didakwa dibawah Seksyen 505(b) Kanun Keseksaan yang membawa hukuman penjara sehingga 2 tahun atau denda.

Sementara kesalahan ketiga p**a boleh didakwa dibawah Seksyen 4(1) Ordinan Darurat 2021 yang membawa hukuman penjara sehingga 3 tahun atau denda sehingga RM100,000-00

Nasihat saya kepada orang awam, elakkanlah berkongsi maklumat yang tidak dipastikan kesahihannya hanya semata-mata kerana kandungan dan tagihan like atau perhatian.

Ketenteraman awam boleh tergugat hanya dengan penularan berita kecil yang menggusarkan.

“Kita patuh undang-undang, kitalah jaguh yang menang”.

PENAHAHAN SITI NURAMIRA OLEH JAWI BUKAN “DOUBLE JEOPARDY”

Dalam undang-undang, seseorang tidak boleh dituduh atas kesalahan sama yang mana dia telah dibebaskan atau menjalani hukuman setelah sabitan.

Prinsip ini dikenali sebagai “protection against double jeopardy”. Sememangnya tidak adil sekiranya seseorang yang disabit membunuh, menjalani hukuman dan kemudiannya dituduh sekali lagi atas kesalahan yang sama. Begitu juga kalau dia telah dibebaskan setelah dituduh kali pertama.

Prinsip ini termaktub dalam Perkara 7(2) Perlembagaan Persekutuan yang berbunyi begini:-

“A person who has been acquitted or convicted of an offence shall not be tried again for the same offence except where the conviction or acquittal has been quashed and a retrial ordered by a court superior to that by which he was acquitted or convicted”.

Kata kunci disini ialah “HAS BEEN ACQUITTED OR CONVICTED” dan “SAME OFFENCE”. Ia bermaksud prinsip “double jeopardy” akan terpakai sekiranya:-

1. Seseorang itu TELAH dibebaskan atau disabitkan kesalahan kali pertama, yakni telah menjalani proses perbicaraan Mahkamah dan Hakim telah membuat keputusan;

2. Dia dituduh semula atas KESALAHAN YANG SAMA.

“Kesalahan yang sama” telah didefinisikan dalam kes Jamali Bin Adnan lwn PP (1985) 2 CLJ 425 dimana Hakim Mahkamah Persekutuan, George Seah menyatakan:-

“The phrase “same offence” is used in Article 7(2) of the Federal Constitution, in s. 59 of the Interpretation Act 1967 and in s. 302(i) of the CPC. In R v Kupferberg (1918) 13 Cr AR 166 at p. 168, A.T. Lawrence J said that:

The offence of which the accused has been acquitted and that with which he is charged must be the same in the sense that each must have the same ESSENTIAL INGREDIENTS…”

Nur Amira dituduh dibawah Seksyen 298A Kanun Keseksaan. Seksyen tersebut antara lain mengandungi, secara ringkasan, “ingredients” berikut:-

1. Perkataan, lisan, bertulis, isyarat, pernyataan zahir, perbuatan, aktiviti atau kelakuan;

2. Menyebabkan suasana tidak harmoni, perpecahan, perasaan permusuhan, benci membenci atau niat jahat ATAU memudaratkan pemeliharaan keadaan harmoni atau perpaduan

3. Diatas alasan-alasan AGAMA

Dia dilepaskan dari tahanan setelah membayar ikat jamin.

Dia kemudiannya ditahan oleh JAWI atas siasatan dibawah Seksyen 7 Akta Kesalahan Jenayah Syariah Wilayah-Wilayah Persekutuan 1977. Seksyen tersebut mengandungi, secara ringkasan, “ingredients” berikut:-

1. Secara lisan, bertulis, gambaran atau cara lain;

2. Menghina agama Islam atau menyebabkan agama Islam dipandang hina;

Perhatikan Seksyen 298A KK mengandungi elemen “menyebabkan ketidakharmonian” yang tiada dalam Seksyen 7 AKJSWP. Perhatikan juga Seksyen 298A menyebut “atas alasan agama” sedangkan Seksyen 7 menyebut terus “agama Islam”.

Tambahan p**a, bidangkuasa undang-undang sivil adalah berbeza dengan bidangkuasa undang-undang syariah.

Oleh yang demikian, saya berpandangan bahawa:-

1. Memandangkan kes jenayah masih dalam peringkat pertuduhan dan belum berlaku perbicaraan dan hukuman, ia bermaksud masih belum “been acquitted or convicted”.

2. Memandangkan “ingredients” kes Seksyen 298A KK dan Seksyen 7 AJKSWP agak berbeza, ia tidak boleh dikatakan “same offence”, walaupun faktanya mungkin sama.

3. Penahanan atau pertuduhan selepas ini oleh JAWI bukan “double jeopardy”.

PLEADING FOR MERCY

Sometimes, advocacy is not only about presenting good argument of laws, but also touching the human side of the law by pleading for mercy from the judge. Justice must also be tempered with mercy, as one would say.

I had a valuable experience on this. I was representing a solicitor who was sued by his former client for overcharging legal fees (oddly, it was not a taxation proceedings but OS instead). The High Court gave judgment to the Plaintiff, and my client was ordered to pay RM3 million or so forthwith. We immediately filed an appeal, and an application for stay of ex*****on.

A night before the hearing of stay application, while I was going through my submission, I realized that there were no special circumstances warranting stay at all. It was a monetary judgment. I knew i will lose the hearing.

On the day of hearing, I decided to just be candid and ask for court’s mercy to my client. I opened my speech by saying this:-

“My Lord, to be frank, I have no special circumstances to argue. This is a monetary judgment. However My Lord, this is a very special and unique case. My client had, at his exertions gotten a substantial amount of damages to his client, the Plaintiffs. After enjoying all the money, the Plaintiffs suddenly decided that it was not enough. They sued my Client. This is not a case of a solicitor swindled money. This is not a case or breach of trust. My client, a distinguished practitioner, having unblemished record, must be at least accorded with some mercy from this Court. Moreover, the appeal is just around the corner. The Plaintiff will certainly not be prejudiced. My client is here, practicing. He cant run away.”

Guess what? Stay granted eventhough i had no special circumstances whatsoever. That, my friend, is the power of advocacy pleading mercy from Court.

NOTE: Of course it applies in a case where the Court has a wide discretion to exercise. In other rigid circumstances, law is the law.

ACCEPTING DEFEAT

It is not easy to accept defeat after you have put in monumental effort in your case. It takes a lot of strength and perseverance mindset to stand strong, regroup and fight back.

In 2013, I suffered a gruesome defeat in litigation. It was difficult to accept at first that the Court eventually dismissed my case when the Court give all kind of hints that you will win. During the trial, the Judge in my case repeatedly said to my opponent representing the Defendants that the Defendants must be somehow responsible, and liable to pay damages. It was just to us, a matter of dollars and cents.

The evidences were overwhelming. The witness performed extremely well under cross-examination. My opponent did not have sufficient rebuttal evidence. All roads led to a secured win.

But suddenly, bamm! The court pronounced in a shortest words “the Plaintiff claim dismissed with no order as to cost”. I was left dumbfounded and appalled. How could i explain to my Client?

It took me nearly a week to digest what happen and lick my wounds. I felt so jaded.

Then I met my friend who said to me “come on, it is just another case right”, and he asked “have you done your best?”. I said “of course!!”. Then he said “then what with the regrets? When you have done your best, it is enough. You have no control whatsover of the result”.

That was the best positive motivation i got in litigation. And until this very day, i hold it dear to my heart. Whenever I lose a case, i will ask the question “Have i done my best?”.

And “yes” is definitely enough.
