⚖️ BicTok #47 – “Force Majeure” under Construction Contracts: Principles for Presenting and Defending Claims

BicTok is back! Following a short pause in July for the BICAM Global ADR Horizons 2026 Conference, our BicTok series returns this August with another timely and practical discussion.

Force majeure clauses play an important role in construction contracts where unexpected events disrupt the performance of contractual obligations. Events such as natural disasters, pandemics, government restrictions, wars, strikes and supply chain disruptions may affect project timelines, costs and liabilities. Whether an event qualifies as force majeure, however, depends on the precise wording of the contract and the circumstances surrounding the disruption.

Join our distinguished panel as they examine the key principles for presenting and defending force majeure claims, including contractual interpretation, causation, notice requirements, mitigation and evidential support. The session will also consider how such claims interact with extensions of time and other forms of contractual relief, with practical guidance for both claimants and responding parties.

A fitting close to BICAM Global ADR Horizons 2026.

On the evening of Day 2 (24 July 2026), our delegates, speakers, moderators, sponsors and supporting organisations gathered at ON22 Restaurant, Hyatt Centric Kota Kinabalu for the Evening Soirée.

Over drinks and conversations, the soirée provided a relaxed and meaningful space to reflect on two full days of discussions, reconnect with familiar faces, build new professional relationships and celebrate the spirit of collaboration within the ADR community.

The evening was made even more memorable with the concluding remarks by BICAM Council Member, Datuk Roger Chin, who brought the conference to a thoughtful close. It was also a special occasion as the evening coincided with Datuk Roger Chin’s birthday, giving everyone the opportunity to celebrate the moment together.

Day 2 | BICAM Global ADR Horizons 2026 (24 July 2026)

The second day of the Conference brought together distinguished judges, practitioners, academics and industry leaders for a series of forward-looking discussions on the evolving landscape of alternative dispute resolution.

From international arbitration and investment disputes to the growing influence of artificial intelligence in legal practice, the sessions examined the opportunities, challenges and practical considerations shaping the future of dispute resolution in Malaysia and across the region.

Our speakers and moderators shared valuable perspectives drawn from different jurisdictions and professional backgrounds, encouraging meaningful dialogue on how ADR institutions and practitioners can remain independent, efficient, innovative and responsive to the needs of businesses and communities.

Day 2 of BICAM Global ADR Horizons 2026 | 24 July 2026

A defining moment for access to justice in Sabah as BICAM officially launched its Pro Bono Mediation Initiative, which will take effect on 1 September 2026.

The launch commenced with special remarks by Yang Arif Datuk Celestina Stuel Galid, who highlighted how mediation complements the judicial process by providing parties with a practical, collaborative and people-centred pathway towards resolution.

This was followed by an address from our Guest of Honour, YB Datuk Seri Panglima Masidi Manjun, who reaffirmed the Sabah State Government’s continued support for BICAM and recognised the importance of strong, independent dispute resolution institutions in strengthening investor confidence, commercial certainty and access to justice.

The occasion culminated in an engaging interactive launch of the Initiative, marking BICAM’s commitment to making professional mediation services more accessible to individuals, small businesses and members of the wider community.

The celebration continued with a vibrant Magunatip performance by Kumpulan Budayawan, offering our international delegates an unforgettable opportunity to experience Sabah’s rich cultural heritage, energy and hospitality.

Throwback to 23 July 2026, as we officially opened BICAM Global ADR Horizons 2026 in Kota Kinabalu.

Day 1 began with the Opening Address by Tan Sri David Wong, Chairman of BICAM, followed by Keynote Address by YA Dato’ Lim Chong Fong, Judge of the Court of Appeal, Malaysia.

The opening session set the tone for two days of meaningful dialogue on the evolving role of ADR, not merely as an alternative to litigation, but as an essential part of a modern, effective and commercially responsive justice system.

Day 1 brought together members of the Judiciary, government representatives, legal practitioners, arbitrators, mediators, engineers, construction professionals, academics, industry leaders and delegates from various sectors and jurisdictions.

With a strong focus on the construction and built environment sectors, the discussions explored collaborative contracting, payment disputes, latent defects, mediation and expert determination, encouraging participants to consider not only how disputes may be resolved, but how they may be better managed and prevented.
