Mediation continues to play an increasingly important role in expanding access to justice by providing parties with a faster, more cost-effective, and constructive avenue for resolving disputes outside the courtroom.

BICAM was honoured to support the seminar “Mediation in Penang: A Decade and Beyond” jointly organised by the Justices of the Peace Mediation Bureau Penang and the Society of JP Community Mediators Penang, where our Chairman, Tan Sri Datuk Seri Panglima David Wong Dak Wah, was invited as a panellist to share insights on the evolving mediation landscape in Malaysia.

During the session, Tan Sri David Wong spoke on the importance of court-annexed mediation, the increasing judicial encouragement towards ADR, and the need to view litigation as a forum of last resort. The discussion also touched on the Sabah Courts’ initiative on court-referred mediation, including BICAM’s pro bono mediation programme for court-referred claims below RM500,000, as well as the proposed pre-litigation mediation protocol currently being developed in Sabah and Sarawak.

As courts and institutions continue to encourage constructive dispute resolution, mediation remains an important tool in preserving relationships, reducing costs and delays, and promoting practical outcomes for parties.

One point raised during yesterday’s “Fair Contracts, Fair Outcomes”: when there are too few jobs and too much competition, contractors may feel pressured to accept whatever clauses employers impose, even when the risks are heavily one-sided.

That is where the conversation on fair contracts becomes so important, not just as a legal issue, but as a practical foundation for better project outcomes.
