🧾 父母没有立遗嘱，房子会归谁？
What happens to your parent’s house if there’s no will?
这是我在免费法律咨询中常被问的问题之一。
很多人误以为：“我是长子，房子自然就是我的。”
但其实在马来西亚，如果没有遗嘱，遗产的分配方式是由法律规定的。
In my community legal consultations, this is one of the most common questions I receive.
Many people assume, “I’m the eldest, so I automatically inherit the house.”
But in Malaysia, inheritance without a will is governed by law, not by tradition.
📜 根据遗产分配法令 1958（Distribution Act 1958），如果父母在世时没有立遗嘱，财产通常会：
- 由配偶、孩子和其父母共同继承 (1/4, 1/2, 1/4)
- 如果没有子女，则由配偶与父母继承 (1/2, 1/2)
- 如果没有配偶或子女，则由父母全数继承
📜 Under the Distribution Act 1958, when someone passes away without a will:
-The estate is shared among the spouse, children, and parents in the proportion of 1/4, 1/2 and 1/4 respectively
- If there are no children, spouse and parents inherit equally
- If there is no spouse or children, parents inherit everything
✅ 所以，有没有立遗嘱，会直接影响财产该如何分配。
