2026 🇲🇾马来西亚雇佣法 - 年假（annual leave）

在马来西亚，公司每年都要给予员工最基本的年假。

常见问题：
1. 公司有没有权利强制员工清空年假呢？
- 答案是不能。❌
- 员工拥有行使年假权利的自由选择。

2. 员工能不能把年假提现现金呢？
- ✅当员工与雇佣者达成协议时， 该名员工可将年假提现，前提是在雇主的要求下，该名员工书面同意不使用年假且放弃拥有年假的权利。

总结：公司不能强制员工清空年假，但员工可以自愿放弃年假以换取金钱补偿，前提是和雇主/公司达成协议。🤝

In Malaysia, companies are required to provide employees with a minimum number of annual leave days each year.

1. Does the company have the right to force employees to clear (use up) their annual leave?
- The answer is No.❌
- Employees have the freedom to choose whether or not to exercise their right to annual leave.

2. Can employees convert their annual leave into cash?
- ✅Yes, if an employee and the employer reach an agreement, the employee may cash out their annual leave. The condition is that the employee must voluntarily and in writing agree not to take the leave and waive their right to annual leave, at the employer’s request.

【对校园霸凌说不｜法律就在你身边】⚖️

6月23日，我们律所的方律师与其他3位律师同行，受邀前往位于 Senai/Kulai 的培正华小，与全校学生一同展开一场充满意义的反霸凌分享会。

[Say No to School Bullying] ⚖️

On June 23rd, our firm’s Lawyer Hong, together with three fellow lawyers, was invited to SJK(C) Pei Cheng Bandar Putra in Senai/Kulai to conduct a meaningful anti-bullying sharing session with all the students in the school.

As lawyers—and as members of society—we believe that legal education should take root from a young age. During the session, the lawyers explained what constitutes "bullying," how to identify it, and how to seek help, all through real-life examples that resonated with the students. They also encouraged the children to bravely say “no” to bullying.

The students responded enthusiastically. The room was filled with questions, interaction, and reflection—we could feel how much the topic meant to them, and we saw in their eyes a strong desire to be understood and protected.

We hope today’s session plants the seeds of “respect” and “courage” in the children’s hearts, so they learn to recognize bullying, speak up about it, and find the strength to stand up against it. 💪🏻🙋‍♀️🙋‍♂️

See you next time, kids! May you grow freely and flourish safely in your school environment. 🤝

外国离婚认证 (Resealing of Divorce) - In Malaysia

在外国离婚，回马来西亚🇲🇾自动update不用理？

只要在马来西亚🇲🇾注册过婚姻，外国处理的离婚程序，JPN并不会自动帮你update婚姻状况哦。

正确的做法是拿到外国的离婚证明后，在马来西亚🇲🇾法庭申请认证(Resealing)

步骤：
1. 拿到外国的离婚证书；
2. 出席律师楼签署认证宣誓书；
3. 等待法庭排期；
4. 出席法庭，除非人在外地；
5. 拿到马来西亚法庭的庭令去JPN update婚姻状况。

注：个别国家庭令或离婚证不同，在马来西亚法庭认证所需文件和程序也会略有不同。

Got divorced overseas — will it be automatically updated when you return to Malaysia 🇲🇾?

As long as your marriage was registered in Malaysia 🇲🇾, a divorce granted overseas will not be automatically updated by JPN (National Registration Department).

The correct procedure is to apply for a recognition (resealing) of the foreign divorce order at a Malaysian court.

Steps:
1. Obtain the foreign divorce certificate;
2. Attend a law firm to sign certain documents;
3. Wait for the court to fix a hearing date;
4. Attend court — unless you are abroad;
5. Use the court order issued by the Malaysian court to update your marital status at JPN.

Note: Divorce orders and certificates vary by country, so the documents and procedure required for recognition in Malaysia may differ accordingly.
