“绝对没有可以直接分他一半家产那么好康的事，你是需要拿出证据，证明给法官看，你应该获得这个分配比例”

“杜律师，如果我跟我老公离婚，我是不是可以分到他一半的家产？”

看戏都是这样讲的，但是大马的法律到底是怎样呢？我们一起来看看吧！

根据《婚姻与离婚法令1976》第76条，只有在婚姻中共同努力获得的资产（matrimonial assets）可以被分配，而且法官还会考量以下3大事项：

第一，你对取得这个资产贡献了多少？可以是金钱方面的贡献。比如说，你付房子頭期、购买家具、或者曾经出过装修费等等…

如果你没有收入，那为家庭的贡献也算。像是，你打理房子、照顾孩子，让另一半可以毫无后顾之忧地去打拼。

原文截取：“the extent of the contributions made by the other party who did not acquire the assets to the welfare of the family by looking after the home or caring the family”

第二，你有没有为了双方的共同利益而陷入负债？例如，你借钱给另一半买车买房。

第三，未成年子女的需求。比如，小孩目前居住在婚房里，或者载送小孩需要用到车。

把以上事项都纳入考量后，法官有权利给出一个他认为合理的分配方法。而实际工作赚钱获得资产的那一方，有权获得比较大的分配比例。

只谈法案有点太枯燥了，我们来看看真实案例吧！

在Shireen v Kanagasingam (2012) 这个案件里，第一套房子是丈夫在婚前买的，妻子无法证明自己对取得这个产业有什么贡献，所以分不到一分钱。而另一套房子也是由丈夫买的，差别在于购买时间点是在婚后。法官认为妻子有照顾家庭方面的贡献，允许妻子获得该产业的35%，丈夫则获得其余的65%。另外，妻子也分到了丈夫EPF的25%。

在Owen Koh v Diana Lee (2021) 中，妻子和丈夫是在一家航空公司工作时认识的。婚后，妻子辞去了经理的职位，全心全意照顾家庭。法官认为，虽然婚房全款由丈夫支付，但考虑到妻子为家庭做出的牺牲，妻子获得了该产业的50%。

另一个案件Ng Bee Lee v Liew Kam Cheong (2010)，婚房也是完全由丈夫出钱购买，在婚姻期间，妻子曾与一个‘老王’走得比较近，法官对她到底有没有尽一个妻子/母亲的责任抱有疑虑。最终丈夫获得65%，而妻子获得35%。

总结来说：

绝对没有可以直接分他一半家产那么好康的事，你是需要拿出证据，证明给法官看，你应该获得这个分配比例。

如果你对获得该资产完全没有出过一分钱的话，直接分配到50%的几率是比较低的，因为第76条偏向于让工作赚钱去买产业的人获得比较大的比例。

有意思😂😇

一名美国名校的校长死后飞进天堂，圣比得带他到一间小屋说："这就是你的家。" 校长住了几天觉得地方太小，人太多，用公车又要排队。

一星期后有一名律师请校长到他家做客，校长到了律师的家吃过饭参观后很惊呀的发现律师住的豪宅有100个睡房，30个客厅，20个饭厅，5个游泳池，10个网球场和50辆豪华汽车。

隔天校长向圣比得大声抗议。圣比得听后说："是这样的....你看，500年来只有一名律师有资格上天堂…"

😱马来西亚逾700亿遗产无人认领，遗嘱的重要性您知道吗❓
最近收到不少来电/whatsapp询问关于长辈往生但没立下遗嘱的事项，很多晚辈都为了类似的事情烦恼不已，不知如何着手， 所以今日就让我们来探讨什么是遗嘱❓ 立遗嘱的好处又是什么❓

遗嘱其实就是指立遗嘱人按照法律所规定的方式处理遗产或其他事务，并于死亡后发生效力的法律行为，其好处包括：-

☑️您可以自由选择您的遗产继承人，而不是让法律来决定
☑️确保您的遗产不会分配给您不认识的亲戚
☑️避免可能引发的家庭纠纷
☑️避免日后繁杂的遗产管理法律程序
☑️遗产继承人能在短时间内取得遗产
☑️若孩子还未成年，可以为孩子选择适当的监护人

那重点来了❗ 什么是财产❓ 财产又包括了什么呢❓ 其中当然包括了您的现金，银行存款，银行定期，珠宝首饰，股票，公司股份，汽车，房屋及土地等等等，不论是联名或个人拥有，都是属于您的财产💰

但为什麽大多数人还是没有立遗嘱的习惯🤷‍♀️ 一般人不外乎认为：-

❌有钱人才需要立遗嘱
❌没什么财产，不需要立遗嘱
❌没有亲人，不必立遗嘱
❌不了解遗嘱的意义和功能
❌认为去世后遗产会自动转让给家人或亲属
❌遗产规划是老人的事
❌迷信，认为不吉利

😱RM70 billion worth of unclaimed estates since MERDEKA, do you know the importance of making the Last Will and Testament‍❓ Recently our law firm has received several calls asking about the intestate successsion, lots of family members are perplexed and have no idea how to proceed. So today, we will be looking at what is a "Will" and what are the advantages of making a "Will"❓

"Will" is a document where a person states his intention as to how his estate is to be administered and distributed after his death and who is to administer it. The advantages include:-

☑️Leave your estates to the beneficiary you chose.
☑️Prevent others with whom you're not as close with to receive the bulk
☑️Minimize the chances of family disputes over the estates
☑️Avoid the need for lengthy court proceedings
☑️Speed up the distribution process
☑️Name a suitable guardian for your minor beneficiary

Here comes the point❗ What can be treated as your estate❓ It may include your cash (whether in your bank savings/current account/fixed deposit), jewellery, shares (quoted or unquoted in the stock exchange), warrants, loan stocks, bonds and securities of any type, shares in company, motor vehicle, housing asset, land, etc. IT IS YOUR ESTATE💰 regardless of the type of ownership (i.e. sole owner, co-owner of joint owner) you held.

But why are there still many people without a "Will"🤷‍♀️ The common reasons are:-

❌Belief that only wealthy people need a "Will"
❌Thought that "I have nothing worth leaving"
❌Thought that "I have no family members"
❌Unaware of the consequences of not having a "Will"
❌Belief that the estate will be transferred to close family members automatically
❌Belief that young people do not require a "Will"
❌Dwelling on death is not a pleasant experience
