The Inland Revenue Board of Malaysia (IRB) has reminded all taxpayers that stamp duty payment and proper stamping of documents are mandatory under the Stamp Act 1949.
Unstamped or improperly stamped documents may not be accepted in official transactions and could lead to serious legal and financial consequences.

๐Ÿงพ What is Stamp Duty?
Stamp duty is a government tax imposed on legal documents such as tenancy agreements, sale & purchase agreements (S&P), loan agreements, and property transfers.
The duty is imposed on the instrument (document) itself โ€” not just the transaction.

๐Ÿ  STAMP DUTY FOR TENANCY AGREEMENTS
Stamp duty is calculated based on the total rental amount for the entire tenancy period:
โ€ข Tenancy not exceeding 1 year โ†’ RM1 for every RM250 of annual rent
โ€ข Exceeding 1 year but not more than 3 years โ†’ RM2 for every RM250 of annual rent
โ€ข Exceeding 3 years or any indefinite term โ†’ RM4 for every RM250 of annual rent
๐Ÿ“„ Additional: RM10 for every duplicate copy of the tenancy agreement.

๐Ÿก STAMP DUTY FOR SALE & PURCHASE AGREEMENTS (S&P) AND PROPERTY TRANSFERS

๐Ÿงฑ 1. Stamp Duty on the Sale & Purchase Agreement (Agreement Duty)

This is a nominal fixed duty imposed on the signed S&P document:
โžก๏ธ RM10 per copy of the agreement.

๐Ÿ˜๏ธ 2. Stamp Duty on Property Transfer (Instrument of Transfer / Form 14A)

Calculated based on the propertyโ€™s purchase price or market value (whichever is higher):
โ€ข First RM100,000 โ†’ 1%
โ€ข Next RM400,000 โ†’ 2%
โ€ข Next RM500,000 โ†’ 3%
โ€ข Amount exceeding RM1,000,000 โ†’ 4%

๐Ÿ’ก Example:
If a property is sold at RM700,000 โ€“
โ€ข 1% on first RM100,000 = RM1,000
โ€ข 2% on next RM400,000 = RM8,000
โ€ข 3% on remaining RM200,000 = RM6,000
Total Stamp Duty = RM15,000

๐Ÿ—“๏ธ COMING SOON: SELF-ASSESSMENT STAMP DUTY SYSTEM (STARTING JANUARY 2026)
Beginning 1 January 2026, the IRB will introduce a Self-Assessment Stamp Duty System through the MyTax Portal.

๐Ÿ“Œ What is a Writ of Possession? How is it different from a Writ of Distress?

A Writ of Possession is a court order that gives the lawful owner or buyer the right to take possession of a property. It is commonly issued after foreclosure, property sale, or a court decision, and directs the sheriff or proper authority to place the rightful party in control of the property. In short, it is about giving physical possession of land or property to the one legally entitled to it.

On the other hand, a Writ of Distress is a court order that allows the seizure of a personโ€™s personal property or goods (not land or buildings) to secure payment of rent or satisfy a debt. Instead of turning over land, it targets movable properties like equipment, vehicles, or inventory.

๐Ÿ‘‰ Key difference:
โ€ข Writ of Possession โ†’ for land, houses, or real property (transfer of possession).
โ€ข Writ of Distress โ†’ for movable goods or personal property (to answer for unpaid obligations).

Both writs are legal remedies, but they serve different purposes.

๐Ÿ‘ฉโ€โš–๏ธ Why You Need at Least TWO Executors in Your Will if You Have Minor Beneficiaries

Many people prepare wills without realising that the law sets special requirements when children or minor beneficiaries are involved.

Under Section 4(3) of the Probate and Administration Act 1959 (Malaysia), if your will leaves property or inheritance to a minor (under 18 years old), you must appoint at least TWO executors or trustees to manage the estate.

โš–๏ธ Why is this required?
When a child is under 18, they are not legally able to manage or hold property in their own name. Executors or trustees will therefore hold the assets on trust until the child reaches adulthood (or any age stated in the will). Having two executors ensures:
โœ”๏ธ Better accountability and transparency
โœ”๏ธ Checks and balances in managing the estate
โœ”๏ธ Greater protection of the childโ€™s financial interests

๐Ÿ’ก What happens if you only appoint one executor?
If your will names only one executor but includes minor beneficiaries, the court may not grant probate until another executor or trustee is appointed. This could cause delays and complications in administering your estate.

โœ… To avoid these issues, it is always safer to appoint two trusted executors (or one executor and a trust corporation such as Amanah Raya) when drafting your will, especially if you have children or young beneficiaries.

Trademarks in Malaysia are governed by:
โ€ข Trademarks Act 2019 (Act 815) โ€“ current law on registration, protection, and infringement.
โ€ข Trade Marks Act 1976 (Act 175) โ€“ applies to older marks registered before the 2019 Act.
โ€ข Intellectual Property Corporation of Malaysia Act 2002 (Act 617) โ€“ establishes MyIPO as the governing body for intellectual property.

Under these Acts, any unauthorized use of a registered trademark โ€” including imitation, reproduction, or false application โ€” constitutes infringement. This may lead to:
โ€ข Civil remedies such as injunctions, damages, and recovery of profits;
