Upon considering facts from the news, we do believe that to fulfil the requirement of Section 269 Penal Code wherein the accused was charged, the conviction is unsustainable. The law required "Negligent act likely to spread infection of any disease dangerous to life". One of the ingredients to proof this offence will be that the accused MUST be tested positives Covid-19 to become 'likely to spread infection of the disease.
In the condition where the accused not effected with Covid-19 virus, the charge against him is unsustainable and the conviction can't stand. Some other offences like breaching S.O.P and so on, more appropriate than Section 269 Penal Code.
Tuduhan di bawah Seksyen 269 Kanun Keseksaan kerana tidak pakai 'face mask' di tempat awam. Seksyen kesalahan ini menetapkan satu perbuatan yang 'Negligent act likely to spread infection of any disease dangerous to life'.
Bagi memenuhi kehendak kesalahan ini seseorang itu harus boleh atau mungkin menyebarkan penyakit, dalam konteks ini tertuduh ialah pembawa virus Covid-19. Tertuduh hanya boleh disabitkan dengan kesalahan di bawah seksyen ini jika dia positif virus tersebut. Oleh itu, kami percaya tuduhan dan sabitan di bawah kesalahan ini tidak boleh bertahan.
Mungkin terdapat kesalahan lain seperti langgar S.O.P pencegahan Covid-19 dan sebagainya.
