Change at Immigration regarding family unity residencies:
We people apply for their residency at a consulate abroad, they often do so through ‘Vínculo Familiar’ (Family unity). This means that one spouse or parent sponsors the residency for their relative. Before, the office in San Miguel de Allende did not require for the application here in San Miguel to contain the apostilled legal documents. That has changed. Now, the office in San Miguel requires for all of the documents (birth certificate, marriage certificate) to be apostilled and translated to Spanish. If the sponsoring spouse is a Mexican citizen, then the marriage certificate must also be registered at the Registro Civil and a process called ‘inserción’ must be carried out.
This is very important if your renewal or change to Permanente is coming up.

In Mexico the structure of someone’s name never changes (there are a few exceptions, but it is very rare), from the time that their birth certificate (Acta de Nacimiento) is created. Whether a boy or girl is registered, that person’s name will not change, regardless of marriage during their lifetime. This is far different from the U.S. or Canadian systems, where people will often have several variations of their name presented on I.D.’s during their life. The Mexican legal system is not flexible when it comes to accepting foreigners who have documents with different variations of their names.
Mexico allows foreigners to gain residency through family ties (residencia por vínculo familiar). However, the documents all need to state the exact same name. Here is an example: A Mexican spouse sponsors his/her U.S. citizen wife. The wife’s birth certificate has the maiden name, but the passport has the wife’s married name. Immigration/Registro Civil will not accept that this is the same person. The way that we solve this issue to present documents to Immigration (when the passport and birth/marriage certificate are not exactly congruent), along with a letter that the U.S. Consular Agency notarizes for us. This letter states that the U.S. citizen is the same person, in spite of the passport and birth/marriage certificate being different variants of the first and last names. Furthermore, we recommend that children born in Mexico to U.S. citizens, have both parents’ last names on the birth certificate. This avoids complications and allows for I.D.’s to always be accepted in Mexico and the U.S.
