On 29 September 2026, the National Commercial Arbitration Centre (NCAC) and UNDP Cambodia successfully co-hosted a workshop titled “Construction and Alternative Dispute Resolution” under the theme “Revitalizing Stalled Infrastructure through Commercial ADR.”

Our Partner, Prom Savada, contributed to this important dialogue as a featured speaker in a breakout session, where she shared insights on the role of commercial arbitration, mediation, and the Arb-Med process in addressing challenges facing stalled construction and real estate projects. Her presentation explored how dispute resolution mechanisms can help projects move forward while safeguarding the rights and commercial interests of all parties involved.

Drawing on practical case studies and interactive role-play exercises, she engaged participants in a realistic mediation experience, demonstrating the value of mediation in construction disputes. The session highlighted how mediation can create value, bridge differences, preserve commercial relationships, and support mutually beneficial outcomes for parties navigating complex project disputes.

The workshop brought together a diverse group of stakeholders, including government officials, diplomatic representatives, industry experts, legal practitioners, business leaders, academics, and students, underscoring the growing importance of alternative dispute resolution (ADR) in supporting Cambodia’s infrastructure and economic development.

Where a third party infringes a trademark, the trademark owner may pursue enforcement action against the infringer. Under Cambodian law, such action may be taken before the relevant authorities or the competent courts.

Administrative Remedies

• Oppose the registration of a conflicting trademark application;
• Seek the invalidation or cancellation of a registered trademark that conflicts with the owner’s prior rights;
• Request for a hearing at the Department of Intellectual Property in connection to the trademark infringement; and
• Request the customs authorities to suspend the clearance of suspected counterfeit goods entering or leaving Cambodia.

Court Remedies

• An injunction restraining the infringing conduct;
• Provisional measures to prevent imminent infringement or preserve evidence;
• Monetary damages for losses suffered;
• The destruction of counterfeit goods;
• The confiscation of infringing goods; and
• Criminal penalties against infringers.

A clear understanding of the remedies available under Cambodian law enables trademark owners to take timely and appropriate action to prevent or mitigate further infringement.

Liability for Unauthorised Use of Third-Party Registered Marks or Well-Known Marks in Cambodia

Under Cambodian Law, it is trademark infringement to use a brand name or logo that is identical, or confusingly similar to a registered or well-known trademark without the owner’s permission. Well-known trademarks are protected even if they are not registered in Cambodia.

An infringer may have the infringing goods seized or destroyed and may also face civil remedies and criminal liabilities, including:

• A fine of KHR 1 million to KHR 20 million, imprisonment for one month to five years, or both;
• Payment of compensation to the trademark owner for losses caused; or
• Any other remedy allowed by law.

Businesses should obtain the trademark owner's permission before using a registered or well-known trademark.
