Can a property be confiscated if it was unknowingly rented out and later used as a scam compound?
Under the Law on Combating Online Scams, confiscation would generally not apply where the landlord or property owner genuinely had no knowledge of the illegal activities, acted in good faith, and was not involved as a co-perpetrator, accomplice, or instigator of the offence.
Nevertheless, landlords and property owners are still required to exercise due diligence and comply with the obligations set out under Sub-Decree No. 03 on Management of Safety and Security in Concentrated Residential Area, including maintaining accurate tenant records and promptly reporting any changes of tenants to the competent local authorities.
