Can a property be confiscated if it was unknowingly rented out and later used as a scam compound?

Under the Law on Combating Online Scams, confiscation would generally not apply where the landlord or property owner genuinely had no knowledge of the illegal activities, acted in good faith, and was not involved as a co-perpetrator, accomplice, or instigator of the offence.

Nevertheless, landlords and property owners are still required to exercise due diligence and comply with the obligations set out under Sub-Decree No. 03 on Management of Safety and Security in Concentrated Residential Area, including maintaining accurate tenant records and promptly reporting any changes of tenants to the competent local authorities.

Can the authorities freeze suspicious accounts linked to technology-enabled scams?

The Law on Combatting Online Scams grants Cambodian authorities the power to take urgent measures against suspicious transactions and accounts connected to scam-related activities. Where suspicious transactions are detected, judicial police officers may request the Cambodia Financial Intelligence Unit to provisionally suspend such transactions in order to prevent the transfer or dissipation of suspected proceeds of crime.

The law also allows the Prosecutor or the court to order the seizure or freezing of accounts and other property linked to offences under the law. These measures are intended to strengthen asset recovery efforts and prevent offenders from moving or concealing proceeds derived from technology-enabled scams.

How does the Law on Combatting Online Scams and its related regulations impose obligations on property owners and landlords?

In light of the ongoing crackdown on scam compounds, owners and landlords of certain “concentrated residential areas” are required to report the temporary presence of foreign nationals staying within their premises to the competent police station and local authorities.

In addition, surveillance camera recordings within the premises must be retained for the minimum period prescribed by law and made available to the authorities upon request, reflecting the government’s broader efforts to monitor and prevent the use of properties for technology-enabled scam operations.

In early 2026, the Ministry of Land Management, Urban Planning and Construction (“MLMUPC“) issued two significant Prakas aimed at strengthening regulatory oversight, safety standards, and accountability in Cambodia’s construction sector.

On 29 January 2026, MLMUPC issued Prakas No. 008 DNS/K.K.C/PRK on Certificate of Elevator Use (“Prakas No. 008“), establishing a comprehensive regime governing the certification, continued use, and compliance obligations relating to elevators across both construction and non-construction contexts. This was followed by the issuance of Prakas No. 033 DNS/PRK/K.K.C on 31 March 2026 on Licence for Elevator Installation (“Prakas No. 033“), establishing the conditions and procedures for the issuance, suspension, and revocation of the licence for elevator installation.

Does a money laundering charge now depend on proving a specific scam?

Under the new Law on Combatting Online Scams, the answer is no.

Article 9 allows an individual to be charged with money laundering based on a reasonable suspicion that their assets are illicit. The critical shift here is that the law now focuses on the absence of a verifiable, legal source for the wealth, rather than requiring the authorities to prove the presence of a specific underlying scam. While due process remains mandatory, this Article places a heavy burden on the individual to maintain clear financial records to rebut the suspicion of illicit activity.
