In appointing and promoting the Judges, the President has acted on sound advise.

In declining to appoint (in some cases) and promote (in some cases) the six Judges, the President has acted on unsound advise.

Every lawyer will tell you that the president has no option but to appoint all the 40. The president, in his ingenuity, raised a political argument (otherwise what is the Political Science Conferment worth?) that the constitution did not desire to tie his hands (merely ceremonial) while making appointments if he had a valid reason to decline appointment.

The problem with this argument (of course it is flat out an affront to the constitution) is the ancillary/colorary argument whether if that is what the constitution intended, then what would happen if after the fact (of appointment) the President received new and important evidence of a particular candidate's unfitness/unsuitability for the job?

Certainly in such a case, the President would be justified to relieve the particular candidate (s) of his/her/their robes since the appointment would have been null and void - like a marriage that never consummated, so there was no marriage in the first place.

This is dangerous because the tenure of a Judges office (as entrenched by the constitution) will have been eroded beyond repair since the safeguards to ensure that the Executive arm does not unduly interfere with the Judicial arm will only be paper mandates (whose worth would be reduced to the ink that penned - as opposed to the ink of the blood of redemption and victory of the 2nd Republic from tyranny).

This is yet another onslaught at the Grand Norm. Let us see what becomes of the struggle of the two branches of government.
