🎉 Festive Season Reminder: Your Privacy at Public Events

As we enter a season filled with concerts, festivals, end-year parties, corporate gatherings, graduations and many public celebrations, it’s important to stay informed about your data privacy rights especially because photography and videography are common at these events.

Here is what you should know:

📸 Being at an event doesn’t mean you’ve given consent.
The Office of the Data Protection Commissioner has confirmed that implied consent is NOT valid.

Organisers and photographers must get your explicit and recorded consent before using your identifiable photo for social media, marketing or publicity.

📢 Events must inform you when photography or videography will take place through entrance signage, announcements or notices on tickets.

🛡️ You have rights:

1. To opt out of photos

2. To withdraw consent

3.To request deletion of identifiable images

4. To ask how your photo will be used

Sample Event Notice:

“This event is being photographed for documentation. Identifiable images will NOT be used for social media or marketing without explicit and recorded consent.”

⚖️ Legal Recourse if Your Image Is Misused:
If an event organiser, photographer, influencer or company posts or uses your picture without your explicit consent, you may:

1.Demand removal or deletion of the image.

2. If they refuse to delete the image, you can file a complaint with The Office of the Data Protection Commissioner for unlawful processing of personal data.

Hello everyone 👋,
I am Alice Wanjiku Ndung'u, the founder of A.W NDUNG'U LAW ADVOCATES.

A little about me:
⚖️ I believe in providing client-driven legal solutions that are practical, compassionate and effective.

💡 I started A.W NDUNG'U LAW ADVOCATES to create a safe space where clients feel guided, supported and empowered through their legal journey. I mainly handle the following matters;

Well the Standard Newspaper made headlines this week with the topic ; No Kiss No marriage

The article was based on the judgment from Eldoret High Court

⚖️ Case Brief: JKS v JGI [2025] KEHC 11961 (KLR)
This appeal arose from a divorce petition where JKS (husband) sought to end his marriage with JGI (wife) citing cruelty, desertion and neglect. The trial court had dismissed the case in 2023, but JKS appealed.
🔑 Key Issues Considered:
Whether cruelty and desertion were proved.
Whether mediation failures and prolonged separation meant the marriage had broken down.
Whether denial of companionship, including conjugal rights, showed the union no longer functioned as a marriage.
📌 Court’s Findings:
Cruelty is both physical and mental; it includes persistent quarrels, disrespect and denial of marital companionship.
Evidence showed the parties had lived apart since 2019 and mediation failed, proving the marriage was beyond repair.
The judge stressed that forcing two unwilling people to remain in a marriage amounts to injustice.
✅ Outcome:
The High Court allowed the appeal and dissolved the marriage, declaring it had irretrievably broken down.
📖 Takeaway:
Kenyan courts will not force couples to remain in a marriage that exists only on paper. Where there is prolonged separation, lack of love and even denial of conjugal rights, the law recognizes that such a marriage is no longer viable.

Kenya is working on a new law to guide how people create and manage trusts.

📌 What is a trust?
A trust is a legal way to hold and manage property like land, money or a house for the benefit of your family, children or a cause you care about.

It is a good way of ensuring preservation of generational wealth without the involvement of court or any other third parties.

🌍 Did you know?
The Rockefeller Foundation, one of the most impactful charitable organisations in the world, was made possible through a family trust set up by John D. Rockefeller in the early 1900s.

💰 Instead of just handing down wealth to his children, Rockefeller used a trust to:

1.Protect his estate for future generations,

2.Fund education, medicine, and science,

3.Give back to society through long-term projects.

📚 Today, that trust continues to fund major global health and education initiatives over 100 years later.
