A constitutional court's greatest duty is not merely to decide disputes, but to provide clarity where the Constitution is contested. That is why the Gachagua judgment is so perplexing.

The Court found procedural violations in the impeachment process, yet upheld the impeachment. It questioned aspects of the process, yet stopped short of explaining why those defects did not invalidate the outcome. More importantly, it failed to conclusively determine whether the allegations met the constitutional threshold for impeachment and what that means for Gachagua's future eligibility for public office.

The result is a judgment that appears to condemn the process while validating its outcome. Rather than settling the constitutional questions before it, the Court has left the country with uncertainty and a decision whose reasoning is difficult to reconcile.
