We, the people and sovereignty of the people under the Constitution.

In Timothy M Njoya & 6 others v Attorney General & 3 others [2004] eKLR, court set out the elements of sovereignty.

Sovereignty has three elements: the power to constitute a frame of Government, the power to choose those to run the Government, and the power to be involved in governing.

The High Court has held that private schools are not private clubs. They are part and parcel of the institutions that offer education as a service and bound by the provisions of the Consumer Protection Act.

In a landmark decision by Justice Janet Mulwa in Martin Mutua & Ors vs St. St Bakhita School Limited & Ors, court has further held that private schools cannot increase school fees without involving the PTA.
