Is altering your employee's employment contracts as good as terminating the existing contract?

In case your employer alters your existing employment contract without consent, you either opt to resign and sue your employer or take up the altered contract and still claim breach of contract.

In a case scenario where you choose to resign and sue the employer, the court seeks to determine whether the employer's action was to terminate the existing contract. If the end result amounted to unfair termination, the court awards the claimant damages suffered in terms of:
1) 1-month salary in lieu of notice
2) Compensation for unfair termination
etcetera

Setting Aside and Objection to Recognition and Enforcement of Arbitral Award;

Section 35(3) of the Arbitration Act requires that a party desirous of setting aside an arbitral award make the application for setting aside within 3 months after receiving the words.

Courts have interpreted that the 3 months start running from the time when the Arbitrator communicates that the award is ready for collection by the parties. The time will start running even when the Arbitrators communicates that the release of the award is subject to the payment of his/her fees.
