Today marked the commencement of the three-day Arbitration Training – Cohort 3 (Accelerated Route to Membership) at Weston Hotel, Nairobi. The training brings together participants seeking to strengthen their knowledge and practical skills in arbitration.

The training attracted representation from all branches of the Law Society of Kenya (LSK), demonstrating the Society’s commitment to promoting arbitration training across the country. Participants travelled from as far as Turkana, Meru, Malindi and Busia, highlighting the nationwide interest in advancing arbitration practice and professional development.

During the opening remarks, Mr. Titus Mukanzi, Council Member and Co-convener of the ADR Committee, welcomed and thanked participants for attending the training. He highlighted upcoming arbitration events and encouraged members to register for the forthcoming Cohorts 4 and 5 to take advantage of available learning opportunities and advance their expertise in arbitration.

Mr. Mukanzi also urged participants to prepare adequately for the November examinations, emphasizing the importance of commitment, continuous learning and professional growth in the arbitration field.

The day's sessions focused on Arbitration Procedure, with discussions centred on the agenda for preliminary meetings, drafting of preliminary meeting documents, and drafting of procedural orders for directions. These sessions provided participants with practical insights into the procedural steps involved in managing arbitration proceedings effectively.

Additionally, FCS Jacque Waihenya led a session on Arbitration Agreements and Clauses, offering participants valuable insights into their role and significance in arbitration proceedings.

The training continues over the next two days, providing participants with further opportunities to deepen their understanding of arbitration practice, engage in knowledge-sharing and build the competencies required to advance their professional practice in arbitration.

On 16th October 2026, the Tribunals Committee of the Law Society of Kenya (LSK), led by its Convener, Amos Ndunda, paid a courtesy call to the Tribunal Appeal Division, where the delegation was received by the Presiding Judge, Lady Justice Janet Mulwa. The engagement sought to strengthen collaboration between the Society and the Tribunal and address key operational and procedural issues affecting the administration of justice.

Discussions focused on the Tribunal’s jurisdiction, transition arrangements and management of pending appeals, filing procedures, timelines and tribunal records. The meeting also identified an information gap regarding stakeholder awareness of the new Tribunal, highlighting the need for targeted sensitisation to familiarise advocates and other stakeholders with its mandate and applicable procedures.

As a key takeaway, the parties identified the need to organise a joint sensitisation webinar to provide guidance on the Tribunal’s jurisdiction, filing requirements, timelines and transition arrangements, including the handling of pending appeals. The webinar is intended to enhance stakeholder understanding and promote procedural clarity.

The meeting further highlighted the need for the designation of liaison persons from the LSK and the Judiciary to facilitate communication, coordinate follow-up on emerging issues and strengthen institutional cooperation. The engagement reaffirmed the importance of continued collaboration in promoting access to justice and efficient case management.

On 16th October 2026 ,the Law Society of Kenya, led by Deputy CEO Ruth Nyaberi,Mr Vincent Githaiga former Council member and Mr Ambrose Waigwa of the Law Reform and Legislative Affairs Committee, presented its memorandum to the National Assembly on the Architectural and Quantity Surveying Practitioners Bill, 2026

The Bill would repeal the Architects and Quantity Surveyors Act (Cap. 525) and place five professions under one regulatory board: architecture, quantity surveying, landscape architecture, interior design and construction project management.

The Society's concerns:
▪️ Merging distinct professions risks weakening regulation, since each has its own competencies, responsibilities and liability framework
▪️ The board's composition and the handling of complaints raise conflict-of-interest questions
▪️ A merger could affect international accreditation and mutual recognition of qualifications
▪️ Efficiency gains can be achieved without a single umbrella framework
▪️ The Bill conflicts with the Architects Bill, 2026, which is also before Parliament

The LSK urges Parliament to reject the joint umbrella-board model and pursue separate, profession-specific legislation, while addressing the drafting concerns in the memorandum.
Good regulation protects the public by recognising how each profession actually works.

The Law Society of Kenya (LSK), led by Deputy Chief Executive Officer Ruth Nyaberi accompanied by Mr Vincent Githaiga, a member of the Law Reform and Legislative Affairs Committee on 16th October 2026 presented a memorandum to the National Assembly Committee on Defence, Intelligence and Foreign Relations on the Foreign Service (Amendment) Bill, 2026.

The LSK recognises the Bill’s objective of strengthening professionalism and merit-based appointments within Kenya’s Foreign Service. A competent and professional diplomatic service is essential to safeguarding Kenya’s national interests and advancing its engagement in an increasingly complex global environment.

While supporting the Bill’s overall objective, the LSK has urged Parliament to address key gaps to promote fairness, inclusivity and accountability. The Society emphasised the need for clear competency criteria, safeguards for diversity, and narrowly defined exceptions for specialised expertise or justified national interest.

A key provision discussed was Clause 3, which proposes that career diplomats constitute no more than 70% of all appointments. The LSK called for clarity on its implementation, alongside measures to broaden eligibility for career status and ensure a balanced and effective Foreign Service.

The Society also highlighted the importance of ensuring that diplomatic appointments reflect Kenya’s gender, regional and other forms of diversity, while upholding professional standards and merit.
The LSK remains committed to constructive engagement with Parliament and other stakeholders to promote legislation that strengthens institutional accountability, protects Kenya’s national interests and fosters an inclusive, professional and merit-based diplomatic service.
