📌 VICTIMS RIGHT TO PARTICIPATE IN A CRIMINAL TRIAL IN KENYA 📌

Victims are allowed to participate in criminal trials but under the conditions that the participation;

✅ Is directed by the Court.
✅ Is allowed at the correct stages.
✅ Doesn't encroach the Prosecutors role.
✅ Doesn't prejudice the Accused rights.
✅ Is relevant and crucial for Fair hearing.

Cross examination of witnesses by Victim's advocates has been allowed by courts based on this decision by the Supreme Court of Kenya ( Joseph Lendrix Waswa v. R ) and the Victim Protection Act.

But can the Victim's advocate cross- examine the prosecution witnesses ❓

📌 CLOSE OF THE PROSECUTION CASE AND A PRIMA FACIE CASE

At the point in trial when the Prosecution has presented all of its witnesses and rests its case, its burden is to provide credible evidence that establishes a prima facie case against the accused, rather than proving the charges beyond a reasonable doubt.

A prima facie case was defined in the celebrated case of Ramanlal Trambaklal Bhatt V Republic[1957] EA 332 in the following terms;

“ ….It may not be easy to define what is meant by a prima facie case but at least it must mean one onwhich a reasonable tribunal, properly directing its mind to the law and the evidence could convict ifno explanation is offered by the defence ….’’

At that stage, the question the court must address is whether, based on the evidence presented by the Prosecution and after carefully considering both the law and the evidence, the court is in a position to convict the accused person if they decide not to present any evidence in their defense.

📌 REVISIONARY JURISDICTION OF THE HIGH COURT IN KENYA

Section 362 and Section 364 of the Criminal Procedure Code (CPC) grant the High Court revisional jurisdiction and supervisory authority over subordinate courts.

This power allows the High Court to correct errors, omissions, or illegal orders on the court record or those made outside established procedure.

The High Court's revisionary jurisdiction is not a substitute for an appeal. It is meant to address clear acts of irregularity, not to re-argue the merits of a case.

The High Court can intervene during or after proceedings in a subordinate court to rectify manifest irregularities and issue directions for the trial’s proper continuation.

This jurisdiction extends to ensuring that proceedings in subordinate courts are legally sound.

If a lower court’s actions have deviated from the law, the High Court can provide necessary directions to restore the trial process to its correct path.

The jurisdiction applies not only to decisions or orders made by a subordinate court but also to the regularity of the court’s proceedings.
