A game-changing ruling from the Supreme Court of Kenya in Sehmi & Another v Tarabana Co. Ltd (April 2025) now sets the record straight on public land lease renewals.

📌 If your lease has expired, the land automatically reverts to the government.
📌 Even continued possession doesn’t protect you!
📌 Only Kenyans enjoy pre-emption rights, and even that must be exercised before expiry.
📌 And government silence is not consent — don’t wait for a letter that may never come.
📌 The court also clarified that illegally or irregularly acquired titles can’t be shielded by the bona fide purchaser doctrine.
