Building Smart Kenyan Cities Through IoT innovations by MWAMU JA SC

The fast and Rapid Urbanization in our county Kenya has created massive and significant pressure on both infrastructure and public services in our major cities such as Nairobi, Mombasa, Kisumu, Nakuru and Eldoret. The serious and major challenges we face are traffic congestion, inefficient waste management, heavy energy usage and poor delivery of services which continue to impact our Urban and peri-urban living Standards. These problems could be cured by adoption of Internet of things (IoT) technologies. Major Smart cities like Amsterdam, Singapore, Barcelona, Seoul, Copenhagen, New York and London have vigorously and deliberately adopted Internet of things (IoT) to revolutionize their cities into efficient, sustainable and people centric smart cities.

The idea of smart Cities revolves around deployment of interconnected devices and sensors to collate, collect, evaluate and analyze real time Data which allows local and National Governments to enhance urban systems. In Kenya for example, Urban population is growing rapidly and so the Internet of things can act as the backbone of this transformation and revolution facilitating smooth communication between infrastructural facilities such as roads, buildings and other urban utilities. This will alleviate the problem of moribund urban planning and service delivery while addressing structural and systemic inefficiencies.

The resolving of the problem of transport and mobility especially in a city like Nairobi is extremely essential and critical. Nairobi for several years has faced and experienced severe Traffic congestion that escalated travel time and pollution. Singapore has efficiently used the internet of things to address the traffic problem through application of smart Traffic system. The city Fathers have deployed sensors, cameras and real data analytics to optimize traffic flow, adjustment of traffic lights dynamically and have substantially reduced Congestion. The City of Amsterdam efficiently applies Internet of things Sensors and analytics to improve smooth mobility in the urban Centre. The cities in Kenya could invest in smart traffic lights, real time public transport tracking and extremely intelligent routing systems to lessen the citizen pain point of congestion and commuting inefficiency.

The endemic waste management failure is a persistent story and tale in our major cities like Nairobi and Mombasa. Copenhagen has used IoT technology to enhance waste management systems by using sensors in bins to monitor fill levels and enhance collection schedules. This has helped the city in reducing operational costs, fuel consumption and environmental pollution. Our cities properly managed could use the smart technology to ensure cleaner urban spaces for the city’s residents. On this score Kisumu has excelled but could do more with investment in smart technology.

The Internet of things plays a major role in energy Management and sustainability in smart Cities. These cities have huge populations that consume large amounts of energy. Kenya Cities are no different. Investment in smart technology like IoT meters, smart lighting and building management systems substantially reduce energy consumption. Singapore uses a IoT sensor to monitor and streamline energy use in buildings. Kenya cities by using smart IoT would greatly improve efficiency and sustainability in line with UN sustainable development goals. The implementation of smart street lighting would help our country in adjusting lighting based on activity levels thus mitigating electricity cost and energy waste.

The City of New York has deployed IoT sensors in pipeline and reservoirs to monitor water flow and quality and usage in real time. This system detects water leaks early. Equally they have flood sensors as Flood net to provide real time Data to manage storms and reduce floods. Kenya cities can use these smart technologies to enhance water distribution, sustainability and delivery to the residents. For cities facing water scarcity and infrastructural challenges, smart IoT can improve water management and distribution network.

A major lesson from the City of Amsterdam is the massive investment in Data Integration and collaboration. The city uses open Data platforms in smart partnerships between Government and the private sector in order to assist business and citizens to drive innovation and improve service delivery. Kenyan Cities must invest in strong digital infrastructure like broadband connectivity and centralized Data platforms to strengthen businesses and current investments in digital connectivity. This would in turn create employment for young people who are tech savvy.

Kenya has challenges of corruption, where chief officers in our counties are still arrested with lorry loads of public funds and ill-gotten monies in their houses impeding progress. Secondly, the high cost of investment, the frequent power outages, aging infrastructure, and growing energy demand that strains the national grid, lack of technical skills undermines the investment in smart technology.


In conclusion IOT presents a powerful tool for transforming Kenyan Cities into sustainable and smart cities. By learning from global examples such as New York, Seoul, Amsterdam, Copenhagen our cities can greatly improve efficiency, reduce environmental abuse and improve our citizens quality of life.

Lawyers must avoid misleading the public with skewed and imbalanced interpretation of the law.Secondly,the courts are seized of this matter and the rules of sub judice must be respected.Thirdly,parents of 16 young people who perished in the fire are in deep grief , any insensitive statements that makes their grief even more worse should be avoided at all costs.

On serious interpretation of the law, my well considered opinion is that while Article 31 of the Constitution guarantees the right to privacy, constitutional rights are not absolute. Article 24 of the Constitution expressly permits the limitation of rights where such limitation is reasonable and justifiable in an open and democratic society, taking into account factors such as the purpose, extent, and necessity of the limitation.

The proper inquiry is, therefore, not merely whether CCTV surveillance intruded into a private space but whether it served a legitimate aim and was proportionate. Courts must balance privacy against competing constitutional interests, including the protection of life, public safety, and the administration of justice. In cases involving serious offences such as murder, the public interest in uncovering the truth and ensuring accountability is particularly weighty.

Further, Article 50(4) establishes a qualified, not automatic, exclusionary rule. Evidence obtained in violation of rights is excluded only where its admission would render the trial unfair or be detrimental to the administration of justice.

Thus, courts must weigh the seriousness of the violation against the probative value of the evidence. Where the evidence is central and reliable, especially in grave criminal matters, its exclusion may undermine justice.

Constitutional adjudication, therefore, requires a principled balance, not the elevation of privacy to an absolute bar, especially where lives have been lost.
