To the moms holding little hands today we see your love, your exhaustion, your joy.

To those missing their moms we hold space for your grief. Her love didnโ€™t leave with her.

To those longing to be moms your heart is already doing the work.

To those who are already empty nesters we see the void but we also see the sacrifice and comfort you gave up.

The Supreme Court of Kenya recently made a landmark decision regarding the division of matrimonial property upon divorce. In the case of JOO v MBO (2023) KESC 4 (KLR), the court ruled that Article 45(3) of the Constitution doesn't automatically entitle spouses to a 50:50 split of matrimonial property.

The court emphasized that each spouse's contribution to the acquisition and development of matrimonial property will determine their share, whether direct or indirect.

The division of property should be based on the contributions of each spouse, and the court should ensure that each party receives a fair share.

The court highlighted that the guiding principle in determining proprietary rights is that apportionment and division of matrimonial property may only be done where parties fulfill their obligation of proving what they are entitled to by way of contribution.
