لم يعد استخدام أدوات الذكاء الاصطناعي في بيئة العمل مجرد مسألة تقنية، بل أصبح يثير تساؤلات قانونية مباشرة حول مشروعية معالجة البيانات الشخصية، وإتاحتها لمقدمي هذه الأدوات، وسريتها، وحمايتها، ونقلها خارج المملكة.
يسلط هذا المقال الضوء على أبرز هذه الإشكاليات في ضوء قانون حماية البيانات الشخصية الأردني رقم (24) لسنة 2023، وما يترتب على المؤسسات عند استخدام أدوات الذكاء الاصطناعي في معالجة البيانات.

The protection of personal data has become one of the most important legal issues in light of the rapid development of digital technologies and the expanding scope of data collection and processing, particularly by government entities that retain large amounts of personal and sensitive data.
One of the key safeguards adopted by modern legislation to enhance compliance with data protection rules is the appointment of a Data Protection Officer (DPO). However, the Jordanian legislator has not expressly required government entities to make such an appointment, unlike the approach adopted under the European General Data Protection Regulation (GDPR).

Accordingly, this issue raises questions as to the extent to which government entities in Jordan are legally required to appoint a Data Protection Officer, and whether the Jordanian legislative framework provides an adequate level of protection when compared with the European regime.

اصبحت حماية البيانات الشخصية من أبرز القضايا القانونية في ظل التطور الرقمي المتسارع واتساع نطاق جمع البيانات ومعالجتها، ولا سيما من قبل الجهات الحكومية التي تحتفظ بكميات كبيرة من البيانات الشخصية والحساسة. ومن أهم الضمانات التي اعتمدتها التشريعات الحديثة لتعزيز الامتثال لقواعد حماية البيانات تعيين مراقب حماية البيانات، إلا أن المشرّع الأردني لم ينص صراحةً على إلزام الجهات الحكومية بهذا التعيين، خلافًا لما قررته اللائحة العامة الأوروبية لحماية البيانات (GDPR). ومن هنا، يثير هذا الموضوع تساؤلًا حول مدى إلزام الجهات الحكومية في الأردن بتعيين مراقب حماية البيانات، وما إذا كان التنظيم التشريعي الأردني يحقق المستوى الكافي من الحماية مقارنةً بالنظام الأوروبي.

هل غيّر نظام العمل المرن معيار التفرقة بين عقد العمل وعقد الخدمات؟

رغم التطور الذي شهده سوق العمل، فإن نظام العمل المرن لم يُغيّر المعيار القانوني للتفرقة بين عقد العمل وعقد الخدمات، وإنما غيّر وسائل إثباته، ويبقى المعيار الأساسي هو وجود التبعية القانونية وخضوع العامل لإدارة وتوجيه صاحب العمل، وليس شكل العقد أو مكان وساعات العمل. فالعبرة بحقيقة العلاقة وواقعها.
