QUESTION: Can a beneficiary under a Will do anything if an Executor has not taken any steps to administer property since a testator’s (person who makes a Will) death over a year ago?

RESPONSE: All executors have a duty to take steps to administer the estate of a testator, as soon as possible following the testator's death. This is especially important since interest will generally accrue on death (estate) duties that may be payable to the government. Also, any delay affects a beneficiary’s right to legally claim property gifted under a Will.

The law makes provision for a beneficiary named in a Will to step into the shoes of an executor that has failed to carry out his duties. If approved by the court, this allows a beneficiary to take the necessary steps to administer an estate.
