Supreme Court Justice Pankaj Mithal has sparked a nationwide debate by suggesting that reservation benefits should ideally be limited to the first generation of beneficiaries. These remarks were made in a separate but concurring opinion delivered in October 2025 during a case concerning the sub-classification of Scheduled Castes and Scheduled Tribes.

Justice Mithal observed that reservation “should be restricted to the first generation,” reasoning that once a family has already received benefits and achieved social or economic advancement, extending the same advantage to subsequent generations becomes difficult to justify. He emphasized the need for a comprehensive review of the reservation framework, recommending periodic assessments to identify and exclude advanced sections so that the most deprived groups are not left behind.

Highlighting that reservation is meant as a tool for initial empowerment rather than a lifelong entitlement, Justice Mithal urged beneficiaries who have progressed to step aside, making space for others who continue to face disadvantage. His comments have reopened discussions on fairness, inclusion, and the long-term objectives of affirmative action in India.

Advocate Haamid Bhat, President, Kashmir Bar Association, conveyed heartfelt condolences to the bereaved family and prayed for eternal peace to the departed soul. He also prayed that Almighty Allah grant patience and strength to the family to bear this irreparable loss.

Advocate Haamid Bhat Raises Serious Concerns Over Dual Positions in Kashmir Advocates Association

Srinagar: Advocate Haamid Bhat, a prominent and outspoken voice of the legal fraternity, has raised serious, principled, and uncompromising objections to the practice of holding dual positions by advocates—particularly the holding of a government law office simultaneously with the post of President of a Bar Association in the Kashmir Division.

Advocate Haamid Bhat categorically stated that an advocate holding a government position cannot and should not function as the President of a Bar Association, as it strikes at the very root of professional independence, neutrality, and ethical conduct. He emphasized that a Bar President is expected to represent the collective interests of advocates, including those who regularly litigate against the State, whereas a Government Advocate or Law Officer posted in the Advocate General’s Office is duty-bound to defend the State, leading to an inherent, direct, and irreconcilable conflict of interest.

Raising a pointed question, Advocate Bhat asked:
“How can a President of a Bar Association simultaneously hold a Government Law Officer position in the Advocate General’s Office and still claim to independently safeguard the interests of the legal fraternity?”
He described such an arrangement as ethically impermissible, professionally untenable, and institutionally destructive.

Expressing grave concern over the functioning of the Kashmir Advocates Association, Advocate Bhat said that such practices severely undermine the credibility and autonomy of the Bar and erode public confidence in the justice delivery system.
“The Bar Association is not a ceremonial body; it is a representative institution meant to safeguard the rights, dignity, and independence of lawyers. Allowing dual roles converts the Bar into an extension of executive influence,” he asserted.

Advocate Bhat further pointed out that the professional ethics framed by the Bar Council of India, along with settled legal principles, clearly prohibit advocates from occupying positions that create divided loyalties or compromise independence. He clarified that the issue is not personal but institutional and ethical, and must be addressed in the larger interest of the legal fraternity.

He categorically urged that the Bar Council of India should take appropriate and immediate action against the Kashmir Advocates Association for permitting such a blatant conflict of interest, stating that failure to act would amount to endorsing unethical practices within the legal profession.

Advocate Haamid Bhat warned that silence on such violations would normalize conflicts of interest, weaken the collective voice of advocates in Kashmir, and seriously damage the independence of the Bar.

He concluded by reiterating that the strength of the Bar lies in its independence, and any deviation from ethical norms must be firmly, transparently, and decisively corrected.

President, Kashmir Bar Association, Advocate Haamid Bhat, has unequivocally rejected and condemned the recently announced JKPSC KCS Mains result, calling it blatantly biased, regionally skewed, and an insult to merit.

Advocate Haamid Bhat stated that the result exposes the deep rot within the recruitment process, where deserving and highly competent candidates from Kashmir Division have been deliberately sidelined, raising a serious presumption of institutional discrimination.

It is impossible to accept that Kashmir known for producing top-ranked professionals, officers, and academicians across India suddenly lacks merit. This result is not accidental; it reflects a systemic bias and selective favoritism,he asserted.

He warned that such engineered outcomes undermine the credibility of JKPSC, erode public trust, and push educated youth toward frustration and despair.

The JKPSC seems to have forgotten that it is not a private fiefdom but a constitutional body bound to fairness, neutrality and equal opportunity.Any attempt to marginalize one region will not be tolerated, Advocate Haamid Bhat said.

He demanded an immediate, time-bound, independent audit of the entire selection process including evaluation, scaling and moderation failing which the Kashmir Bar Association will be compelled to initiate legal and democratic action.

Merit cannot be sacrificed at the altar of bias. Kashmir’s youth will not remain silent spectators to this injustice, he concluded.

District Courts Are the Real Classroom of Law: CJI Surya Kant

New Delhi, Jan 19: The Bar Council of Delhi hosted a felicitation ceremony for Chief Justice of India Justice Surya Kant on Monday, held in the lawns of the Delhi High Court, with all Delhi district court bar associations in attendance.

In his address, CJI Kant emphasized that young lawyers should commence their practice in district courts prior to transitioning to high courts or the Supreme Court, referring to them as the "breeding centres of professional culture." He dispelled the notion that graduates from NLUs must directly practice in higher courts, stating that real legal skills are cultivated at the grassroots level.

Reflecting on his own journey, Justice Kant attributed his success to his district court practice, where he honed his skills in drafting, witness examination, and courtroom craft. He noted that true justice is first manifested in district courts, where the law becomes immediate and humane for litigants.

The CJI also expressed concern regarding the declining art of cross-examination due to technological advancements and urged senior lawyers to mentor their junior counterparts. Delhi High Court Chief Justice D.K. Upadhyaya described Justice Kant's journey as one of "persistence over privilege," highlighting his rise as a first-generation lawyer.

The event was attended by judges of the Supreme Court and Delhi High Court, along with senior members of the Bar.

Advocate Haamid Bhat Seeks Establishment of IIT and IIM in Kashmir on Constitutional and Legal Grounds

Advocate Haamid Bhat, President, Kashmir Bar Association, has formally called upon the Government of India, Ministry of Education, and the Union Territory Administration of Jammu & Kashmir to initiate and approve the establishment of an Indian Institute of Technology (IIT) and an Indian Institute of Management (IIM) in the Kashmir region, citing constitutional mandates and principles of equitable development.

In his statement, Advocate Bhat emphasized that the continued absence of premier national educational institutions in Kashmir, despite their establishment in other regions of the same Union Territory, raises serious concerns of regional imbalance and unequal treatment, which are inconsistent with the spirit and letter of the Constitution of India.

He stated that Articles 14 and 21 of the Constitution guarantee equality before law and the right to live with dignity, which necessarily includes equal access to quality education and institutional infrastructure. “Educational planning by the State must adhere to constitutional norms of fairness, reasonableness, and non-arbitrariness. Selective allocation of premier institutions cannot withstand legal scrutiny,” he observed.

Advocate Haamid Bhat further noted that the lack of IIT and IIM in Kashmir has compelled students to pursue professional education outside the region, resulting in economic hardship, academic displacement, and loss of local intellectual capital. He stressed that such outcomes are contrary to the State’s obligation to promote inclusive growth and regional parity.

Referring to past precedents, he pointed out that in the case of AIIMS, the initial allocation was made outside Kashmir, and only after considerable delay was a separate institution sanctioned for the region. “This recurring pattern underscores the need for a transparent, legally defensible policy framework governing the distribution of centrally funded institutions,” he stated.

Advocate Haamid Bhat urged the competent authorities to treat the demand for IIT and IIM in Kashmir as a matter of constitutional duty and administrative fairness, rather than discretion. He also stated that failure to address this issue may necessitate the exploration of appropriate legal remedies in accordance with law.

He concluded by reaffirming that balanced educational development is integral to social stability, national integration, and the rule of law, and called for timely and reasoned action in the interest of justice and equity.

NLU Is Our Right, Not a Demand to Be Suppressed Through Pressure Politics: Advocate Haamid Bhat

President, Kashmir Bar Association, Advocate Haamid Bhat, today asserted that the establishment of the National Law University (NLU) in Kashmir is a legitimate, constitutional, and democratic right of the people of the Valley and not a privilege to be denied due to pressure tactics adopted by certain Jammu-based organizations.

Advocate Bhat categorically stated that Kashmir has always believed in peaceful, lawful, and institutional methods to assert its rights and will continue to do so. “We do not want to fall into violence or chaos. Our demand for NLU is rooted in logic, population, academic need, regional balance and access to justice not in agitation, threats, or street pressure,” he said.

He expressed serious concern over the aggressive and disruptive methods being adopted by some Jammu-based groups to influence the decision-making process, warning that such tactics are harmful to regional harmony and democratic values. “Rights cannot be snatched through intimidation. Kashmir will not respond with violence, but it will not surrender its rightful claim either,” Advocate Bhat added.

The President, Kashmir Bar Association, reiterated that NLU in Kashmir is essential to address the educational vacuum in the Valley, strengthen legal academia, and ensure equal opportunities for students who otherwise face social, financial, and geographical barriers.

Advocate Haamid Bhat called upon the UT Administration and the Government of India to act with fairness, neutrality, and constitutional wisdom, and to resist pressure politics. He emphasized that any decision taken must reflect regional justice, inclusivity, and democratic principles, rather than appeasement of one region at the cost of another.

He concluded by stating that Kashmir’s demand will remain peaceful, firm, and unwavering, and urged all stakeholders to engage in constructive dialogue instead of deepening regional divides.

President Kashmir Bar Association Advocate Haamid Bhat Urges Caution Against Posting Personal Photographs on Social Media.

Srinagar : President of the Kashmir Bar Association, Advocate Haamid Bhat, has strongly urged the people of Kashmir particularly women and young girls to exercise utmost restraint and caution in uploading personal photographs on social media platforms.

Advocate Bhat warned that with the rapid advancement of Artificial Intelligence (AI) tools, personal images are increasingly being misused, morphed, manipulated, and exploited without consent, leading to serious violations of privacy, dignity, and personal security.

He emphasized that AI-driven misuse of photographs has resulted in cases of fake profiles, deepfake content, online harassment, blackmail, and reputational harm, which often leave victims with limited and delayed legal remedies.

“Once an image is uploaded online, it can be permanently stored, altered, and misused beyond the control of the individual. Prevention is the strongest safeguard,” Advocate Bhat stated.

He further appealed to families, educational institutions, and civil society to create awareness about digital safety, ethical use of technology, and the legal consequences of cyber exploitation.

Advocate Haamid Bhat also called upon the law enforcement agencies and cyber crime cells to remain vigilant and take strict action against those found misusing AI technology for unlawful and immoral purposes.

The statement concluded with a reminder that digital freedom must be exercised with responsibility, and personal safety must take precedence over online trends.
