J&K High Court Quashes Trial Court Orders in Service Matter for Lack of Jurisdiction

Justice Sanjay Dhar of the J&K High Court quashed orders of the Civil Judge (Senior Division), Anantnag, directing release of service benefits to Abdul Wahid Sofi, a retired Technician-III of the Power Development Department. The Court held that the matter, being a “service matter” under the Administrative Tribunals Act, 1985, falls exclusively within the jurisdiction of the Central Administrative Tribunal (CAT), rendering civil court proceedings without jurisdiction.

Govt Advocate Faheem Nisar Shah appeared for the UT, while Advocate T. A. Lone represented Sofi.
