सुप्रीम कोर्ट ने उत्तराखंड हाईकोर्ट के दो बच्चों वाली महिला को मातृत्व अवकाश देने से इनकार के फैसले में दखल से इनकार किया
सुप्रीम कोर्ट ने उत्तराखंड सरकार के उस नियम में दखल देने से इंकार कर दिया है जिसमें दो या दो से अधिक बच्चों वाली महिला को इस आधार पर मातृत्व अवकाश देने से इनकार किया गया है कि उसके पहले ही दो या दो से अधिक बच्चे हैं। पीठ ने कहा कि यह राज्य सरकार का नीतिगत निर्णय है। जस्टिस आर बानुमति और जस्टिस ए एस बोपन्ना की पीठ ने उर्मिला मसीह की उच्च न्यायालय के 17 सितंबर, 2019 के आदेश के खिलाफ दायर याचिका खारिज कर दी। पीठ ने कहा कि हमें उस आदेश में हस्तक्षेप करने का कोई कारण नहीं दिखाई देता है, जिसमें उच्च न्यायालय ने उचित रूप से विचार किया है कि बनाया गया नियम एक नीतिगत मामला है और इस तरह कोई हस्तक्षेप नहीं किया जा सकता है। याचिकाकर्ता ने एक घोषणा की मांग की थी कि दो या अधिक जीवित बच्चों वाली महिलाओं को मातृत्व अवकाश नहीं देने का प्रतिबंध असंवैधानिक है। उन्होंने कहा था कि राज्य महिला कर्मचारियों को दो जीवित बच्चों के साथ मातृत्व अवकाश पर प्रतिबंध लगाने का मौलिक नियम 153 संविधान के न्यायोचित कार्य और मातृत्व राहत की उचित और मानवीय स्थिति से निपटने के लिए मातृत्व लाभ अधिनियम, 1961 और अनुच्छेद 42 का उल्लंघन करता है। उत्तराखंड हाईकोर्ट ने याचिकाकर्ता को इस आधार पर कोई राहत देने से इनकार कर दिया था कि मातृत्व लाभ अधिनियम, 1961 राज्य सरकार के कर्मचारियों पर लागू नहीं है और अनुच्छेद 42 निर्देश सिद्धांतों का एक हिस्सा होने के नाते अदालत द्वारा लागू करने योग्य नही हैं !
