🖊️Can sell HUF property the consent of other joint family members?
👉Supreme Court clarified that “an HUF is capable of acting through its Karta or an adult member of the family in the management of the HUF property.”.
👨‍⚖️Sri Narayan Bal v. Sridhar Sutar, {1996 (8) SCC 54}🖊️ wherein, it has been held that the Karta has the right to sell/dispose of/alienate an HUF property, even if a minor of the family has undivided interest. The reason is that an HUF is capable of acting through its Karta or an adult member of the family in the management of the HUF property.
==> Therefore, The son(s) or other member(s) of the HUF be to the mortgage. alienation, a may the act of a Karta, the alienation is "legal necessity" "betterment of the estate".

🤮unlike some e-learning channels, as such I don't like to make posts on such nangu-pungu matters (or ek-tha-tiger-james bond matters) for sake of pageviews.

But, I am posting this news matter only in context of one of the UPSC Mains questions in the past- where they asked about "constitutional morality versus religious morality".

this new judgement becomes an interesting case study in that context.

वैसे तो कुछ अन्य ई लर्निंग चैनलों के विपरीत ऐसी नंगी-पुंगी चीजों पर pageviews के पोस्ट लिखना मुझे पसंद नहीं। UPSC टीचर के रूप में मैं उसे अपनी गरिमा के ख़िलाफ़ समजता हूँ।।

किंतु मैं इसे सिर्फ इस संदर्भ में लिख रहा हूं क्योंकि एक बार यूपीएससी ने मुख्य परीक्षा में पूछा था कि संवैधानिक नैतिकता और धार्मिक नैतिकता में अंतर बताइए?

तो आप गौर करें धर्म के हिसाब से तो अश्लील साहित्य देखना और दिखाना (वितरण करना) दोनों ही अपराध है.

किंतु निजता के संविधानिक अधिकार का हवाला देते हुए अदालत यह बता रही है कि अश्लील साहित्य देखना आपकी निजता का अधिकार है!
