Not every case can be appealed as a matter of right. For many disputes, the only path to the Supreme Court is through a Special Leave Petition (SLP).

Article 136 of the Constitution of India gives the Supreme Court discretionary power to allow an appeal from any judgment or order of any court or tribunal in India.

An SLP is not an automatic right. It is a request to the Court, asking it to examine whether a case warrants its attention. The Court decides whether to grant leave. If it does, the matter is heard as an appeal. If it refuses, the order of the lower court stands.

SLPs are filed across civil, criminal, and constitutional matters. They are also how many of India's most significant judgments have reached the Supreme Court.

Because the remedy is discretionary, the strength of the legal grounds presented is crucial.

The Transgender Persons (Protection of Rights) Amendment Act, 2026, is now law. It makes significant changes to how transgender identity is legally recognised in India.

The 2019 Act allowed self-declaration before the District Magistrate for a certificate of identity. This is now replaced with a medical board process. A board headed by a Chief Medical Officer evaluates the applicant, and the DM issues a certificate only after their recommendation.

The amendment also narrows the definition of who qualifies as transgender and introduces penalties, including life imprisonment, for compelling a person to present as transgender.

Six years after Jayaraj and Bennix died in police custody, a Madurai court has awarded the death penalty to nine police officers.

In June 2020, the father-son duo was detained at the Sathankulam Police Station for allegedly keeping their mobile shop open past permitted hours during the COVID-19 lockdown. Both died within days due to injuries sustained in custody.

The Madras High Court took suo motu notice of the incident. The CBI was given charge of the investigation. The chargesheet named ten officers; one died during the trial.

On March 23, 2026, the First Additional District and Sessions Court, Madurai, convicted all nine surviving accused of murder and destruction of evidence.

On April 6, 2026, Judge G. Muthukumaran sentenced all nine to death, describing it as a rarest of rare case. The officers were also directed to pay Rs. 1.40 crore in compensation to the victims' families.

For over a century, Section 309 of the IPC made it punishable by imprisonment or fine.

This changed in two steps.

In 2017, the Mental Healthcare Act created a presumption that anyone who attempts su***de is under severe stress. This effectively stopped prosecution in most cases.

In 2024, the Bharatiya Nyaya Sanhita replaced the IPC and omitted Section 309 entirely. Attempted su***de is now generally not an offence in India.

The law has shifted its focus from punishment to care and rehabilitation.

One exception exists: Section 226 of the BNS makes it an offence to attempt su***de specifically to pressure a public servant. This is narrow and distinct from the broader decriminalisation.

This is one of the most significant changes in criminal law in recent years.
