WhatsApp has moved the Delhi High Court against the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 challenging the “traceability” clause that aims to break its end-to-end encryption. The petition challenging the constitutional validity of the IT Rules 2021 was filed on May 25, 2021 which was the last day to comply with the said Rules.
The Rules prescribe compliances for intermediaries to identify the first originator of the information circulating in the app. WhatsApp has opposed to the traceability clause alleging that the aforesaid clause is violative of a person's right to privacy as enshrined in the Supreme Court judgment of KS Puttuswamy v. Union of India.
The Central Government in a press release dated 26 May 2021 stated that “As per all established judicial dictum, no Fundamental Right, including the Right to Privacy, is absolute and it is subject to reasonable restrictions. The requirements in the Intermediary Guidelines pertaining to the first originator of information are an example of such a reasonable restriction.”

On May 5, 2021 in the case Dr Jaishree Laxmanrao Patil versus The Chief Minister and others, the Supreme Court has passed significant judgment by 3:2 majority that the 102nd Constitution Amendment has abrogated the power of states to identify "Socially and Educationally Backward Classes(SEBCs)".
The majority judgment held that after the introduction of Articles 338B and 342A to the Constitution "the final say in regard to inclusion or exclusion (or modification of lists) of SEBCs is firstly with the President, and thereafter, in case of modification or exclusion from the lists initially published, with the Parliament". The majority observed that the power of identification of SEBCs hitherto exercised by the states now shifted to the domain of the President (and for its modification, to Parliament) by virtue of Article 342A and that it does not in any manner violate the essential features or basic structure of the Constitution.

On May 07, 2021, in the case of RAHUL SHARMA & ANR. V/S NATIONAL INSURANCE COMPANY LTD. & ORS., the Supreme Court of India has reiterated that addition of 40% income must be given towards future prospects while computing motor accident compensation if the deceased was self - employed and was aged less than 40 years.
The Appellants instituted a claim petition before the Motor Accidents Claims Tribunal (hereinafter, “the MACT”) under Sections 166 and 140 of the Motor Vehicles Act, 1988, for grant of compensation.
In the present case, the Supreme Court reworked the compensation by granting 40% addition towards future prospects and deducting 1/3rd towards personal expenses.

The present Article represents a Relationship of Limitation Act and Insolvency and Bankruptcy Code of India. This article peep into analysis of powers of courts to provide 'condonation of delay' under Section 5 of Limitation Act and discretionary power of the courts for condoning delay and the discretionary powers of the courts to determine the condoning of the delay. Section 5 of the Limitation Act enables the court to do substantial justice and that is the precise reason why very elastic expression "sufficient cause" is employed therein, to sub-serve the ends of justice. No hard and fast rule can be laid down in dealing with the applications for condonation of delay. The length of the delay is not the criteria but the correctness of the reasons or the explanation for the delay is the important factor. Thus, it is important to determine the date on which the cause of action arises for the courts to determine the limitation period in IBC. Read on for more on our article at -https://lnkd.in/ft9V99F
