Sec. 452 of IPC - Whoever commits house-trespass, having made preparation for causing hurt to any person or for assaulting any person, or for wrongfully restraining any person, or for putting any person in fear of hurt, or of assault, or of wrongful restraint, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
CLASSIFICATION OF OFFENCE
Punishment-Imprisonment for 7 years and fine-Cognizable-Non-bailable-Triable by any Magistrate-Non-compoundable.
In the present matter, after giving due consideration to the fact of Air and Noise pollution caused by the other side and after considering the fact that the offence does not require custody, our client was granted the Anticipatory Bail. The matter still being in NGT, it is important to be seen what steps are taken by the local administration to safeguard the villagers.
"The ground reality is different from what appears on paper, all forums have been approached by the farmers to stop the work, but it is surprising how the complaints of farmers are not taken cognizance of. It is indeed a case of tort and police vigilance is required."
