Sec. 452 of IPC - Whoever commits house-trespass, having made preparation for causing hurt to any person or for assaulting any person, or for wrongfully restraining any person, or for putting any person in fear of hurt, or of assault, or of wrongful restraint, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
CLASSIFICATION OF OFFENCE
Punishment-Imprisonment for 7 years and fine-Cognizable-Non-bailable-Triable by any Magistrate-Non-compoundable.

In the present matter, after giving due consideration to the fact of Air and Noise pollution caused by the other side and after considering the fact that the offence does not require custody, our client was granted the Anticipatory Bail. The matter still being in NGT, it is important to be seen what steps are taken by the local administration to safeguard the villagers.

News in Prabhat Pune Webpage.
A case concerning fraud of admission of students in reputed College, leading to discovery of Hawala Racket and several people made accused of. Surprisingly, mere suspicion cannot take form of proof and despite having no name or role of our client in the present case, the Police issued summons to our client without specifying the reasons for it. However, Interim protection is Granted to our client and it is a relief for now.

Amidst the lockdown in entire country. And with regards to detailed guidelines provided by the Commissioner and PMC to Petrol Pumps from refraining themselves to provide petrol to only those people and in those circumstances that seem necessary considering the nature of lockdown, a few goons, showing displeasure with the non-providing of fuel by the victim, assaulted him with Paver Block causing him 9 stitches on head and his body. Despite the injuries being clearly grevious in nature, the Police registered the offence u/s 324 which is bailable and did not take steps to register the same u/s 326 of IPC which is non-bailable. Shows the lack of cognizance on part of the machinery.

A Classic example where a complainant misuses and misguides the Police Machinery at 2 Jurisdictions to Register an FIR by hook or by crook. Where once a Police station having recorded detail reasons for making a closure Report, the complainant approaches another Police station in favourable Jurisdiction to get the same offence Registered thereby causing Double Jeopardy. Plus both versions seem contradictory and imaginary. The rest of the findings are a subject matter of Civil Dispute which ofcourse lives open upon the court. But whether the present complaint is maintainable at all or falls under sec. 420 of Indian Penal Code, where no Promise or Inducement or Intention is even prima facie found is to be seen.

All in all, Good work team.
