According to Model Rules Framed by The Bihar State Bar Council For Bar/Advocates'/Lawyers Association Of The State Of Bihar and it's ammendmend dated 11:08:2005 Rule- 15 is very specific and conclusive. Rule-15 is being reproduced here for better appriciation.

Rule -15 Terms Of The Office Bearers:- Terms of office bearers and the members of the Executive Committee shall be two years from the date of election. The existing office bearers and members of Executive Committee shall continue to hold office until completion of period of two years from the date of their election. After expiration of the terms of the Executive Committee shall cease to function and the President shall assume charge of the committee and shall take steps to hold the election within a period of one month of his so assumption of charge.

There after ammendmend as on 11.08.2005: " The President if fails to hold election within the period shall become functus officio." The Chairman of the Bar Council shall make interim arrangement for two months, who shall get the election of the Office bearers completed within that period or period extended by the Bar Council.

Some important points for consideration are:
1. As per Rule -15 if specific date of term of Office Bearers have been assigned as two years from date of election means terms of Office Bearers ended on 14th May 2018, then how this Executive Committee, conducted Centenary Celebration 2018 on 18.05.2018?
2. As per Rule-15, after 13th May 2018, term of Executive Committee / office bearers ended and President of the said committee assume charge of the committee, then how Office Bearers such as General Secretary, Treasure etc done financial transactions from the Associations' Bank Account.?
3. All office bearers are knowing that their term is/ are going to be ended w.e.f. 14.05.2018, then also General Body Meeting of the Association not called. Why?
4. All are intitional, well planned, well drafted..
Financial activities done by members who has no power to do.. Their terms ended.
Committees' term ended but committee doing work as usual they have no power to sign cheques on or after 14.05.2018 but more than 20 lakhs rupees withdrawn/ paid vide cheques under whose direction or whose signatures??
