Marriage Certificate "

A valid Proof Of Hindu Marriage Only When Marriage Ceremony Has Been Performed As Per Sec. 7 Of Hindu Marriage Act: Supreme Court.

Section 7 of HMA, 1955: A ceremonies of a Hindu marriages "solemnised", which means to perform the marriage with ceremonies in proper form. Unless and until the marriage is performed with appropriate ceremonies and in due form, it cannot be said to be "solemnised".

Section 7 of the Act also stated that a mere issuance of a certificate by an entity in the absence of the requisite ceremonies having been performed, would neither confirm any marital status to the parties nor establish a marriage under Hindu law.

BLACK MAGIC ACT

Maharashtra Prevention and Eradication of Human Sacrifice other Inhuman and Aghori Practices and Black Magic Act, 2013.

The original bill of 2003 was drafted by Narendra Dabholkar. In July 2003, the draft was approved by the state government. The bill was sent for ratification to the Union government by Chief Minister Sushilkumar Shinde in August 2003. However, it was criticised for having poor definitions of terms like superstition, black magic, spells, sorcery etc. The bill was not presented in the winter session of the legislature.

The bill to enact the law was titled the Maharashtra Prevention and Eradication of Human Sacrifice and other Inhuman, Evil and Aghori Practices and Black Magic Bill 2013, also known as the Anti-Superstition Bill, Black Magic Bill, Anti-Jaadu Tona Bill or Jadu Tona Andhshradha Virodhi Bill. It was introduced in the Maharashtra Legislative Assembly on 11 December 2013 by State Social Justice minister Shivajirao Moghe. The bill was passed by the Legislative Assembly on 13 December and by the Legislative Council on 18 December 2013. The bill received assent from Sankaranarayanan on 20 December 2013.

:138 NEGOTIABLE INSTRUMENTS ACT:

In Observing that a judgment of the civil court will be binding on the criminal court to the extent of sentences or damages, the Supreme Court on Tuesday (April 2) set aside a conviction in a criminal case for cheque dishonour under Section 138 of the Negotiable Instruments Act based on a finding in a civil suit between the same parties that the cheque was offered as a security.
