Recruitment for overseas employment is regulated by the Emigration Act, 1983. Engaging in overseas recruitment without valid registration certificate is violation of Section 10 and is an offence as per Section 24 of the Act ibid. It is also a cognizable offense u/s 26 of the Emigration Act, 1983.
