📂 ED vs Arvind Kejriwal

ED ने आरोप लगाया था कि
पूर्व दिल्ली CM Arvind Kejriwal ने PMLA के तहत भेजे गए summons का पालन नहीं किया और इसी non-compliance को लेकर दो complaints दाखिल की गई थीं।

लेकिन कोर्ट ने क्या कहा? 👇

⚖️ Court का साफ स्टैंड:
❌ “Sirf non-appearance ke base par prosecution sustain nahi hota.”

➡️ कोर्ट ने ED की plea को accept करने से इनकार किया
➡️ दोनों मामलों में Kejriwal को acquit कर दिया गया
➡️ Trial court level पर proceedings खत्म

📌 हालांकि detailed judgment अभी आना बाकी है,
लेकिन इतना clear है कि PMLA summons की non-compliance alone, action के लिए sufficient नहीं है।

🧠 Big Legal Takeaway:
Law में process follow करना ज़रूरी है,
लेकिन process को pressure tool नहीं बनाया जा सकता।

Can a court force husband and wife to live together?

Is video mein hum Section 9 of Hindu Marriage Act ko clearly explain karte hain, jise Restitution of Conjugal Rights kaha jata hai. Bahut logon ko lagta hai ki court husband-wife ko zabardasti saath rehne ka order de sakta hai, lekin reality thodi different hai.

Is video me aap janenge
• Section 9 kab apply hoti hai
• Restitution of Conjugal Rights ka actual meaning
• Kin situations mein Section 9 apply nahi hoti
• Court kyun saath rehne ke liye force nahi karta
• Legal remedy aur legal pressure ka difference

Agar alag rehne ka valid reason ho, jaise: cruelty, dowry harassment, ya life threat,

Section 35(3) BNSS नोटिस: गिरफ्तारी या सिर्फ बुलावा? | Notice of Appearance

BNSS की धारा 35(3) का उद्देश्य गिरफ्तारी से बचने का एक वैध और कानूनी तरीका प्रदान करना है। यह धारा पुलिस को यह अधिकार देती है कि वह व्यक्ति को गिरफ्तारी से पहले एक नोटिस जारी करें, ताकि वह व्यक्ति थाने में पेश हो सके और पूछताछ का हिस्सा बन सके।

Section 35(3) of BNSS states that The police officer shall, in all cases where the arrest of a person is not required under sub-section (1) issue a notice directing the person against whom a reasonable complaint has been made, or credible information has been received, or a reasonable suspicion exists that he has committed a cognizable offence, to appear before him or at such other place as may be specified in the notice.

Chennai के एक एडवोकेट कपल के साथ The Leela Palace, Udaipur में एक चौंकाने वाली घटना हुई। कपल होटल के "Grand Room with Lake View" में ठहरा था। उन्होंने आरोप लगाया कि कमरे की घंटी बजने पर उन्होंने अंदर से स्पष्ट रूप से 'No Service' चिल्लाया, फिर भी हाउसकीपिंग स्टाफ Master Key का इस्तेमाल कर कमरे के अंदर घुस गया।

उस वक्त कपल वॉशरूम में था, जिससे उनकी Privacy का गंभीर रूप से हनन हुआ।

इस अपमानजनक अनुभव के बाद, कपल ने District Consumer Disputes Redressal Commission (Chennai North) में शिकायत दर्ज कराई। कोर्ट ने मामले की गंभीरता को देखते हुए इसे Deficiency in Service का स्पष्ट मामला माना। कमीशन ने कहा कि एक 5-star luxury hotel से ऐसी उम्मीद नहीं की जा सकती कि वे अपने मेहमानों की निजता और सुरक्षा का सम्मान न करें।

The Leela Palace, Udaipur को कपल को ₹10 Lakh का Compensation देने का आदेश दिया गया है। यह हर्जाना मानसिक प्रताड़ना और प्राइवेसी के उल्लंघन के लिए लगाया गया है। यह फैसला सभी होटल्स के लिए एक बड़ा सबक है।

सुप्रीम कोर्ट से उमर खालिद व शरजील इमाम की जमानत याचिका ख़ारिज, अन्य पांच आरोपियों की जमानत स्वीकृत।
