In an important ruling, the Delhi High Court held that courts cannot compel lawyers to disclose the source of documents filed on a client’s instructions. The Court clarified that such disclosure is protected under Section 126 of the Indian Evidence Act, which safeguards professional confidentiality.

The Bench made it clear that judicial curiosity cannot override statutory privilege, and unless there is prima facie evidence of fraud, a lawyer cannot be forced to reveal privileged communications or information. Stated that “The Court can seek the truth, but it cannot compel disclosure of what the law expressly protects.”
