Nagpal & Associates LLP recently acted for our esteemed client The Press Trust Of India Ltd.- PTI. India’s premier news agency, in a matter involving trademark infringement, passing off, and copyright violation.
An entity operating under the name Press Truth of India had adopted a mark identical/deceptively similar to our client’s well-known trademarks “PRESS TRUST OF INDIA” and “PTI”, including imitation of the distinctive trade mark, colour scheme, typography, and taglines. The infringing activities extended to unauthorised reproduction and dissemination of copyrighted audiovisual content on digital and social media platforms.
Upon issuance of a comprehensive cease-and-desist notice asserting rights under the Trade Marks Act, 1999 and the Copyright Act, 1957, the infringing party:
✔️ Acknowledged our client’s prior use and statutory rights
✔️ Ceased all infringing use of the impugned marks and trade identity
✔️ Deleted and permanently disabled all infringing social media handles and content
✔️ Undertook not to use, apply for, or claim rights in any mark identical or deceptively similar to “PTI / Press Trust of India”
✔️ Tendered an unconditional apology
This matter is a textbook example of enforcement against dishonest adoption, likelihood of confusion, dilution of a well-known trademark, and misappropriation of copyright-protected works, particularly in the digital ecosystem where brand misuse can rapidly erode goodwill.
