RIGHT TO DIE WITH DIGNITY Die WITH DIGNITY: Supreme Court’s Recent Order in the Harish Rana Case

The Supreme Court of India recently delivered a significant order in the case concerning Harish Rana, a man who had been in a permanent vegetative state for more than a decade following a severe accident. After careful medical evaluation and considering the prolonged suffering involved, the Court permitted the withdrawal of life support under the framework of passive euthanasia.

This decision reaffirms the constitutional principle that the *right to life under Article 21 also includes the right to die with dignity*. While active euthanasia continues to remain illegal in India, passive euthanasia, which involves the withdrawal or withholding of life-sustaining treatment under strict safeguards, has been recognized as legally permissible since the landmark 2018 Common Cause judgment.

In this case, the Court also acknowledged the extraordinary devotion shown by Rana’s parents, who had cared for him tirelessly for over twelve years. Their plea was not one of abandonment, but of compassion, seeking a dignified end to prolonged suffering.

The ruling highlights the delicate balance the law must maintain between preserving life and respecting human dignity. It also underscores the importance of clear medical procedures, judicial oversight, and ethical sensitivity when dealing with end-of-life decisions.

As India continues to develop its jurisprudence on euthanasia and end-of-life care, this case may further encourage legislative and policy discussions on creating a more structured legal framework for such deeply complex situations.
