In a significant order upholding the sanctity of personal liberty and settled bail jurisprudence, the Hon’ble Court granted regular bail in a case alleging r**e on the pretext of marriage.
The Court observed that consensual relationships turning sour cannot automatically be given a criminal colour.

BAIL GRANTED

In a significant judicial development, the Hon’ble Court granted bail to the accused in an extortion case after it was found that the Investigating Agency failed to comply with the mandatory procedural safeguards laid down under BNSS and the directives of the Hon’ble Supreme Court regarding arrest and detention. The arrest was made without furnishing the written grounds of arrest to the accused, thereby violating the fundamental right enshrined under Article 22(1) of the Constitution of India.

Advocate Pradeep Rana and Abhishek Rana, appearing on behalf of the accused argued that the arrest was vitiated due to non-compliance with legal provisions and judicial precedents. The Court took cognizance of this lapse and observed that procedural fairness cannot be compromised even in serious allegations involving extortion and threats.
