Maintenance can be sought under Domestic Violence Act, 2005 by a Live-in-Partner- Says SC
A three-judge bench comprising CJI Ranjan Gogoi, Justice Uday Umesh Lalit and Justice KM Joseph was considering the questions referred to it in 'Lalita Toppo vs. State of Jharkhand'
The Court held that "In fact, under the provisions of the DVC Act, 2005 the victim i.e. estranged wife or live-in-partner would be entitled to more relief than what is contemplated under Section 125 of the Code of Criminal Procedure, 1973, namely, to a shared household also."
It also said that economic abuse also constitutes domestic violence as per the provisions of the Act..

घर खरीदाने वाले घर विलंब से मिलने पर अनुबंध में निर्दिष्ट टोकन राशि से उच्च मुआवजे की मांग कर सकते हैं : NCDRC
National Consumer Dispute Redressal Commission की खंडपीठ ने एक मामले में निर्णय दिया कि
भवन निर्माता और खरीदारों के साथ हुए समझौते के उस क्लॉज़ की आड़ नहीं ले सकते जिसमें कहा गया है कि अगर मकान सौंपने में विलंब हो रहा है तो विलंब की पूरी अवधि के लिए वे प्रति माह पाँच रुपए प्रति वर्ग फुट के हिसाब से मुआवजा देकर बच सकते हैं। आयोग ने कहा है कि खरीदार को मकान का कब्जा लेने के बाद ज्यादा मुआवजा मांगने का विकल्प है और वह चाहे तो चुकाई गई राशि को वापस करने की मांग भी कर सकता है।
डॉ. एसएम कानितकर और दिनेश सिंह की खंडपीठ ने कहा, “देरी के लिए मुआवजे (5 रुपये प्रति वर्ग फुट प्रति माह) एक अनुचित रूप से लंबे समय तक या अनिश्चित काल के लिए नहीं हो सकता है; सबसे अच्छा यह एक छोटी अवधि के लिए हो सकता है जो उचित प्रतीत होता है...देरी के लिए टोकन मुआवजे के साथ अनिश्चित या अनुचित देरी बिना किसी सीमा के हमेशा के लिए जारी नहीं रह सकती है (ऐसी स्थिति बेतुकी होगी)अगर ऐसी स्तिथि आती है तो मूल राशि पर उचित ब्याज दर के साथ मुआवजे के रूप म् देना पड़ सकता है।

MAKING FALSE MARRIAGE PROMISES FOR SEXUAL RELATION AMOUNT TO R**E- MP HIGH COURT

In a recent judgement MP High Court's Justice Sushil Kumar Palo referred SC's Judgement in case of "State of U.P. v. Naushad", SC had observed, “A woman’s body is not a man’s plaything and he cannot take advantage of it in order to satisfy his lust and desires by fooling a woman into consenting to sexual in*******se simply because he wants to indulge in it. The accused in this case has committed the vile act of r**e and deserves to be suitably punished for it."
The Court was hearing a petition filed under Section 482 of the Cr.PC, challenging an order passed in July, 2017 by the JMFC under Section 156(3) of the Cr.PC, directing registration of FIR under Sections 498A & 376 of the Indian Penal Code and under Dowry Prohibition Act against the man and his parents.
The accused had challenged the FIR on the ground that neither his statement nor a police report was recorded before lodging of the FIR.
With regard to the Offence under Section 376, the court asserted As consent for sexual in*******se was obtained by petitioner no.1 inducing the believe to the prosecutrix that the petitioner no.1 would marry her, it seems to be “fraud” that was practised on her or that she was deceived by false assurance. The “consent” so obtained by deceitful means is not a “free consent” and the offence comes within the ambit and ingredients of definition of “r**e”.

सुप्रीम कोर्ट के मुख्य न्यायाधीश दीपक मिश्रा सुप्रीम कोर्ट से रिटायर हो गए हैं। 65 साल के हो जाने के बाद 1 अक्तूबर उनके कार्यकाल का अंतिम दिन था। सुप्रीम कोर्ट के मुख्य न्यायाधीशध्यक्षता वाली संविधान पीठ के फैसले...

1.सबरीमाला मंदिर में महिलाओं के प्रवेश की अनुमति-
2.आधार मामला- आधार के कुछ प्रावधानों को निरस्त कर दिया गया पर बहुमत से इसे गैर संवैधानिक नहीं बताया।
3.व्यभिचार को अपराधमुक्त करना- न्यायमूर्ति मिश्रा ने अपने फैसले में कहा की पत्नी या बेटी किसी की संपत्ति नहीं है कि उस पर स्वामित्व जताया जा सके।
4.समलैंगिकता अपराध नहीं-मिश्रा ने कहा कि एलजीबीटी समुदाय को भी वे सारे अधिकार उपलब्ध हैं जो किसी सामान्य नागरिक को हैं। यौनिक अनुस्थापन उनके निजता के अधिकार का आवश्यक हिस्सा है। उन्होने कहा कि यह धारा बहुसंख्यकों के हाथों में हथियार की तरह है।
*5.इच्छामृत्यु पर फैसला -सभी वयस्क जिसको सम्मति देने की क्षमता है, उसको चिकित्सा लेने से इनकार करने और स्व-निरधारा का अधिकार है। पर उन्होंने कहा कि डॉक्टर किसी मरीज की सहमति के अधिकार से बंधा होगा।...
6.उम्मीदवारों की अयोग्यता का मामला- मुख्य न्यायाधीश मिश्रा की अध्यक्षता में पाँच जजों की पीठ ने फैसला दिया कि सिर्फ इसलिए कि किसी उम्मीदवार के खिलाफ किसी आपराधिक मामले में अभियोग लगाया गया है, वह चुनाव लड़ने के अयोग्य नहीं हो जाता है।
7.हादिया मामला- मिश्रा ने फैसले में कहा कि कोई कौन सा धर्म चुनता है यह उसके मौलिक अधिकार का हिस्सा है। हादिया की शफ़िन जहां से हुई शादी को वैध करार दिया।
8.खाप पंचायत - किसी दो वयस्क को आपस में शादी करने के लिए किसी परिवार और समुदाय की अनुमति की जरूरत नहीं है। इस बारे में फैसला न्यायमूर्ति मिश्रा की अध्यक्षता में तीन जजों की पीठ ने सुनाया 'इस तरह की शादी में रुकावट डालने या उन्हें ऐसा करने से रोक लगाना कानूनन अपराध है।'
9.कावेरी विवाद- पीठ ने कर्नाटक को 192 की बजाय 177.25 टीएमसी जल छोड़ने का आदेश दिया।...
10. पद्मावत को दिखाये जाने पर लगे प्रतिबंध को हटा दिया-
अभिव्यक्ति और बोलने की स्वतंत्रता पर ज़ोर डालते हुए न्यायमूर्ति दीपक मिश्रा की पीठ ने फिल्म पद्मावत को दिखाये जाने पर लगे प्रतिबंध को समाप्त कर दिया।
11. निर्भया मामले में मौत की सजा-
न्यायमूर्ति मिश्रा की अध्यक्षता में तीन जजों की पीठ ने निर्भया बलात्कार मामले में अभियुक्तों की मौत की सजा को सही ठहराया।
11.याक़ूब को फांसी-
न्यायमूर्ति मिश्रा की अध्यक्षता में तीन जजों की पीठ ने याक़ूब मेमन को फांसी देने के मामले की आधी रात को सुनवाई की। फैसला सुनाये जाने के कुछ घंटों बाद उसे फांसी दे दी गई।

"COUNTRY'S HISTORY OWES APPOLOGY TO LGBT COMMUNITY"-SUPREME COURT
आज एक ऐतिहासिक फैसले में सुप्रीम कोर्ट में पांच जजों की संविधान पीठ ने समलैंगिकता को भारतीय दंड संहिता ( IPC) की धारा 377 के तहत अपराध की श्रेणी से बाहर(Discriminalize) कर दिया। सुप्रीम कोर्ट में गुरुवार को करीब एक घंटे तक चार जजों ने अपने फैसले को सुनाया और कहा कि LGBT समुदाय को भी देश के सामान्य नागरिक की तरह संविधान से मौलिक अधिकार प्राप्त हैं और धारा 377 सहमति से दो व्यस्कों द्वारा यौन संबंध बनाने को लेकर समानता, निजता और गरिमापूर्ण जीवन जीने के अधिकारों का हनन करती है। सुप्रीम कोर्ट ने 2013 के सुरेश कौशल बनाम भारत सरकार के फैसले को पलट दिया।...
जस्टिस एएम खानविलकर के साथ मुख्य न्यायाधीश दीपक मिश्रा ने अपने फैसले की शुरुआत शेक्सपीयर से करते हुए कहा कि यौन प्राथमिकता जैविक और प्राकृतिक प्रक्रिया है और इसमें किसी भी तरह का भेदभाव मौलिक अधिकारों का हनन है।अतंगरता और निजता किसी की व्यक्तिगत इच्छा है और दो समलैंगिक व्यस्कों के बीच सहमति से यौन संबंध पर धारा 377 संविधान के अनुच्छेद 14 के तहत समानता के अधिकार का उल्लंघन करती है और मनमानी है। हालांकि जबरन या असहमति से बनाए संबंध इस धारा के तहत अपराध बने रहेंगे।

Sticker will be Fixed on the Vehicles Soon by 2 Oct,2018 in NCR Region, For /CNG and for Vehicles- SUPREME COURT
The Supreme Court, being on issue, has directed that hologram-based colour code be put on vehicles for of type of fuel being used—light blue for petrol/CNG and orange for diesel .
The stickers will help the authorities identify polluting vehicles. During the hearing of regarding air pollution, suggested that colored stickers be put on the windshield of vehicles to indicate the type of fuel being used.
The suggestion was accepted by appearing for the Centre and the Society of Indian Automobile Manufacturers (SIAM). “Of course this should be applicable for the region by latest"
Meanwhile, in an affidavit filed in the court, " said it has been studies
( which cost may occur aprox. 14 cr with a time of 6 month) for using a mixture of and CNG as fuel for buses,which may be from Environment Fund as fund lying in it", ordered the bench.
