The Maharashtra Real Estate Regulatory Authority (MahaRERA) has directed the city-based developer Darode Jog Homes Pvt Ltd and Krushnai Developers to refund the amounts paid by purchasers of 15 flats of the project Padmanabh Phase II situated at Mouje Dudulgoan, Pune for delay in giving them possession of the flats.
A total of 16 home buyers had moved the tribunal via lawyers Nilesh Borate and Sudip Kenjalkar in 2020. According to their plaint, they booked flats in Padmanabh Phase II, of which the promoter is Darode Jog Homes Pvt Ltd. They also registered agreements with the promoter in 2016, according to which the possession was promised to be given in December 2018 or within 2.5 years from date of agreement, whichever is later with a grace period of six months. However, the promoter failed to deliver the possession of the flats. Hence they approached the authorities. In their plaint they named Darode Jog Homes Private Limited, Sudhir Chandrakant Darode, Anand Jog, Parshuram Kurhade, his brothers Nandkumar, Prakash, Vijay, Chandraprabha Satav, and Ashalata Mungase. The Kurhades, Satav and Mungase are the co-promoters and the land owners.
On the MahaRERA Project registration web page the proposed completion date of the said project is mentioned as December 31, 2018 and revised proposed completion date is December 2021. Further, the promoter has not applied for extension of the project. Thus, the project lapsed since January 2022.
