Supreme Court takes stock of and across India.

Key points to focus:
Absence of proper discourages people to concerns
POSH implementation is not only limited to implementing policies
InternalCommittees should not only be existing on papers
POSH Act should not be looked upon merely as tickthebox compliance
Implementation should be seen as a cultural shift

The Court is making all its efforts to ensure uniform implementation across the country. Are we making equal efforts to make sure that our workplaces are safe?

Supreme Court and Women's Commission call for stringent !

While on one hand the Maharashtra Women's Commission expressed concerns over implementation and suggested mandatory , Supreme Court on the other hand issued a strict directive dated August 12, 2025 demanding POSH !

What does the SC directive say?

- to be mandatorily formed at all by October 14, 2025
- and to check compliance of each
- Compliance to be uploaded on the portal by October 14, 2025
- may lead to cancellation of business licence and strict
- HRs to perform internal POSH to identify gaps, liase with authorities and promote

Call for - POSH implementation at your workplaces

- Check if your Internal Committees have been formed. If not start the process NOW!
- Document every appointment by passig the board resolution and issuing appointment letters
- Start setting agendas for the Committees to meet regularly
- Document minutes of every meeting of the Committee
- Focus on conducting awareness sessions for all your employees including the , , , , and every relevant assoicated
- Design a people centric POSH and ensure it's regular
- Display necessary posters communicating details of the Committee and
- Extend cooperation to your district authorities during the survey and DO NOT PANIC!

Ministry of Corporate Affairs (MCA) notifies Companies (Accounts) Second Amendment Rules, 2025 - from July 14, 2025!

The focuses on strengthening the and compels companies to disclose the following details in the :

-Number of sexual harassment complaints received
-Number of complaints disposed of
-Number of cases pending for more than 90 days

Aforementioned pointers were always a part of Annual Report filed under POSH Act, 2013 however, re-emphasizing the responsibilities of and promoting a culture of in providing authentic information regrading POSH, this amendment is a significant step towards reassuring and environment work.

What will be the possible impacts of this amendment?

- of employer (Board of Directors) will be tightened, resulting in their actual involvement in setting up the
- Less / no misrepresentations would happen as there would be consistency and synchronization in information shared in all the reports
- Emphasis of employers would shift from check the box compliance to implementing actual
- Role of members would be enhanced
- Lack of knowledge would no more be an excuse
- Employers and IC members would brainstorm upon taking and implementing .
