'Consumer Law'

In this post we will be discussing what you need to do if you come across a defect in a product or a service.

Before going to the Court, the buyer must get in touch with the seller. When I say seller, it means you must get in touch with the customer service of the online platform from where you purchased your product OR the shop from where you purchased it OR the company whose product you purchased.

You should call them to seek a solution to your problem. You don't have to settle for a solution they offer, you can demand what solution you would like.

If this solves the problem, great! But if not, then you can send them a LEGAL NOTICE.

A good legal notice can solve a lot of problems, you may not even have to go to the Court.

To draft a legal notice:

1. Document heading will be 'Lgeal Notice' in Bold.

2. Address your complain to the company you plan to sue, also the shop keeper plus the online platform. Start your first paragraph by mentioning, what you bought, where you bought it, how much you paid for it, the defect the product/service has.

3. In the next paragraph, mention how you tried to contact them but they all still failed to help you. (It would be good to mention here about what you told them and how they replied) And that's why you are forced to go to the Court for justice.

4. In this paragraph tell what you want them to do (Eg. Give me a full refund/new product) and that you are giving them 14 days time to reply and solve your problem after which you will go to the Consumer Court and the News Papers if necessary and claim additional damages from party for all this hassle.

5. Lastly, attach your email communications if any, your purchase receipt, your warranty information if any. Pack these documents in an envelope and use RPAD which is Registered Post Acknowledgement Due, it's a service at your nearby post office. Through which you can know who received your package and when. This receipt is important then you decide to go to the Court so take care of it.

6. Now post multiple copies of these notices to the the head office of the companies, shop keeper, you plan to sue. You will get the address from their websites.

Wait for 14 days and see how it goes!
